How to settle my hubby's outstanding car loan if he is no longer here? Question for everybody..

Hi friends in QL,

Three years ago, (Dec. 2006) my husband took a carloan (5 yrs. to pay) just before i came here on Feb. 2007. after paying for 2 years, he went back home to Philippines, and later on decided not to come back due to some health problems. Since he left, for more than a year now, we were not able to pay the monthly due for the car loan and becomes outstanding now. How can i settle the loan without any obligation to pay the arrears? or should i be liable for the outstanding loan though i am not yet here when he took the loan? will the bank chase me for this? what if somebody wants to continue paying it, what and how to do it without any hassle on my part? please do help me for this or just give me some advice to enlighten me...

again all you get here PLS remember is Amateur advise.... not legal and not necessary true..

so it might possible you are not responsible for the payment of the loan but in some countries you are and if you are here in Qatar only real legal advise can assist.

Legal advise does not need to cost. dont see this as a burden

there are social service office around town who can help and better advise.

get informed about your options before closing a door

so seek your options and get more professional help. a social service officer can also contact Police on your behalf or the bank and try to negotiate... beside this there are other options too. ask around, your embassy for example....

Oh my... Anteca, you make me feel so afraid now... coz the car is with my position since in the first place, he has no intention of not coming back when he went on vacation, but since he found some health problems during his stay in the Philippines, he decided not to come back so the car was left with me and it is parked here in our place. what will i do now? i dont like to have problem with this car....

If the car is with you then BANK can chase you but if car is not with you then sleep peacefully as you are not the one who took car from the bank......better to consult with any legal adviser before contact to Bank....but as per my knowledge, they will not chase you....unless you give them a chance to chase you....

you mean even when they learned that i am his wife and i am here in doha they will not chase for my husbands' loan? they will not obliged me to pay the balance? well in that case, i can at least have peace of mind... thanks to your reply

Thanks for the prompt reply... it is greatly appreciated, regret that i cannot get a lawyer to help me for this coz it is an additional burden for me to pay the lawyers services.... all i want is to have peace of mind since i am not using the car and it was parked only since it was left to me coz i dont know how to drive and no license at all. just want to surrender it to the bank where it is loaned, but i am quite afraid that i might be in trouble when i surrender the car to them... anyways, thanks again for your time..

The car was registered under your husband's name. Check the istimara. So you need his signature for any ownership transfer in case someone is willing to continue the loan. Better talk to the bank directly to inform them about the situation and make a settlement. You are not liable whatsoever since you were not a party to the loan. the only problem now is you will never sell the car on your own. And the bank will take the car sooner or later and you cannot do anything about it. Better talk to the bank. Your husband even if his in the phils can face problems if the bank will file a case against him.

sometimes banks do not follow up on small issues. best is check with a lawyer if the bank has filed a court case

if they did, you/he should pay but get legal advise first (not in this forum) you might be lucky and the bank forgot about it.. :)

A Lawyer can negotiate on your behalf also a acceptable rate to pay back if needed and possible reduce the damage and make it reasonable

I would recommend get a lawyer and see his advise (remember this forum only can give you amateur advise we are not layers)
