URGENT ...Sponsorship Transfer

Hi,

My issue is bit complecate, kindly help me out, I was working for a company (X) for more than 5 years and then got an offer from another company (Y) and resigned from my employment, unfortunately my employer (X) refused to give NOC and transfer paper to my would be employer (Y) in particular, because they have some high level personel dispute with company (Y). So my would be employer (Y) suggested me to transfer my sponsorship to another third party company (Z)and requested me to obtain NOC from third party company (Z),then wanted me to cancel my RP and go back to my country immediately. The would be employer (Y) agreed to process new visa for me to come back. My questions are

Upon transfer of my sponsorship to a third party company (Z) immediately can I cancel my residency to enable my would be employer (Y) to process visa.

Can I come back to Qatar immediately upon cancellation my RP with NOC? regardless the period that I stayed under One sponsor?

Help me out...

Hi tinkerbell10,

I have similar situation here, My previous Comp X gave me NOC and release for Comp. Y and then Comp Y processed and approved by immigration but my passport and RP still not submitted. Consequently ive got another job offer from Comp Z so i talked to Comp Y and they agreed to give me release and NOC for Comp Z.

My questions are:

1. Do i need to ask another NOC from my Comp X because my RP and Passport in not yet changed to Comp Y

2. Since Comp Y will give the transfer form with immigration stamp and NOC to Comp Z that would be enough say without another NOC from Comp X?

Please need your opinion very badly. Thanking you in advance.

tinker, one last question/s because i still not the idea yet..i just want to make this one clear..

Q1 - if i work in comp x and transfer to comp z, my former company will be the one to give me borrowing card, right or wrong?

Q2 - so since the borrowing card is valid only for one year, what will happen if - should i say - i like now my present company? can my former comp deport me? i'm i still under their mercy or it's my present comp who is responsible for me now?

how about if after a year, your previous company will not give you NOC after you completed the 1 year period for Borrowing Card..what happen?

U can ask ur current employer to cancel ur visa and issue you an open NOC (stating for any other company)at the time of ur departure. Then ur new company (y) can use that NOC to get ur new visa immediately. Other wise u will have to be stuck with Z company for 1 year before getting any thing

you can not transfer immdetely, but the third party company(Y) that give you new visa can give you 6months TRANSFER letter to (X) because according to qatar rule you must spend minimum 2yrs with one sponsor before u can transfer.In some cases they accept 1 year transfer.check expartraite law

Article 15

No natural or corporate person may permit expatriates brought to the state for work to be

employed by other entities or employ any workers not sponsored by such person.

Notwithstanding the above, the competent authority may authorize a sponsor to lend his

Expatriate workers to another employer to work for such employer for no later than six

months, which may be renewed for similar terms.

The competent authority may also authorize any expatriate to work for some time for another

employer other than during the working hours of the original employer, provided that the

sponsor of such Expatriate agrees thereto in writing.

At all events, the approval of the Ministry of Labour shall be obtained in connection with the

categories governed by the provisions of the Labour Law.

You need to stay with Company Z for a year then bcoz Immigration will not allow you to transfer sponsorship below 12 months.

Also, you could only transfer sponsorship 3x.

Plus, if Company X hired you from your country, they have the prerogative to cancel your working visa with them thus you will be banned from working in Qatar for 2 years.

If you were hired here in Qatar (local hire), then Company X should give you an NOC...but still they can also NOT issue you an NOC...its their call.

You could come back using a business/tourist visa.

I have a friend who are in the same situation like yours. She was persistent...so her sponsor surrendered her passport to Immigration, got her picked up by the police and escorted to the airport for deportation.

If I were you...try to be on the good side of your current employer. THINK TWICE if Company Y is worth all the trouble you gonna be into. Coz next thing you will realize, they'll not be helping you at all...AND GET SOMEONE ELSE.
