Absconding

Good afternoon everyone. Please i would need your view with regards to a "absconding case". If a company affirmed at the CID department that a staff has absconded, how can an employee clear his name as he now wants to leave the country for good? Is it wise that he go to CID department and let them know his plan of leaving and to clear his name? Please advise. Thank you.

not reporting for work? He or she should have a resignation letter (received by the company) and should have travelled back within the specified period. If this person was terminated, then he is also should have travelled back home within a certain period of time. Since no NOC was given, the person should have travelled back home then with an exit permit from the sponsor.

Your best bet would be to speak to a lawyer first and visit the Labor department before you go to CID. Better to have all ur bases covered coz the CID is gonna be looking for this person anyways.
The company refuse to issue NOC and we respect that. All we are up to now is to get clearance from the CID as such the person can now go back in his country without the intention of returning until the next couple of years. On another note, what made the company decide to make a record against him at the CID is still unseen. He however managed to get hold of his passport up to this time.
were you given one when you resigned? (assuming you did).
It would be better if you could tell me the whole story why your employer got lead to surrendering your passport to CID and reported you absconding....PM it to me...

and the only thing I had with me was that NOC letter.
I could refer her/him to the HR company who sorted out my documents with the CID.
To my knowledge; If your employer has reported you as absconding, the CID will arrest you on sight. If you go to them, they will just thank you for saving them the trouble and lock you up there and then. If you have an NOC that is valid and a letter accepting your resignation then you may stand a chance. But otherwise they will hold you until they are ready to send you home. And even if you do have documented proof that you did not abscond, expect to spend some time in jail until things get verified.

As far as I've heard if you go to the CID they will just put you in Jail no questions asked. Later you can talk about whatever deals you want to make..but be prepared to spend a night in jail...or many nights in jail depending on how slow the procedures is.
Happened to someone i know, and while this someone I know was in jail heard it from others in there as well.
he or she will definitely need to deal with CID for that person need an exit permit from his sponsor. But he or she can also run for help to his or her embassy for assistance. The person can bargain for a speedy compromise or make a court hearing and wait until he or she clears his/her name and go home afterwards.
The sooner the matter is deal with, the better.
