clause in rent contract

Hi,

Do all rent agreements have such a clause saying that lesee cannot terminate the contract in between the contract period and if he does, will still be liable to pay full value of the contract. ?

Appreciate any comments that will help me decide weather to continue my search or sign up on this contract.

I am pretty sure you cant be penalized for leaving Qatar, this one is definately one to check out.

broke our rental agreement - we just had to give 2 months notice and that was that. Even though in the contract it stated that we had to pay out for the reminder of the contract.

So I think it depends on the landlord.

I am looking for a villa in Doha, and some of my friends have already rented apartments and villas. Common to them all is the principle that if you are leaving Qatar then you have to pay one months penalty and lose your deposit (one month). However if you are moving and intend to remain in Qatar you are due for the remaining value of the rental period.

I went through a similar situation in Bahrain, but negotiated with my Londlord so that I found him a replacement tenant at no cost to him. (but not all landlords may be as ccommodating!)

Rock, I think there is a stipulation for this upon mutual agreement of both tenant and landlord and the period is 2 months. The thing is, people are so desperate for housing that they have been taken advantage of. I hope this trend will start to die out as the rents decrease but we will have to see.

Good luck with your flat, Al Emadi is one of the better agencies here as they own their own properties, hence cutting out the middle man.

Do you guys think that the law should also set a maximum liability for the tenant in case the contract is broken (i mean in the case when not RP is not cancelled). I am for it. Would like to hear your opinion.

Considering that landlord also needs some protection. My question here is about introducing a maximum liability on the tenant. 1 month or 2 month notice sounds very fair, but apparently it is not standard in all contracts these days. That's why i am suggesting that the law should prescribe this as well.

Thanks Amoud, will look it up. I guess the law does come above the contract and all clauses in the contract have to conform to the law else that clause automatically becomes invalid.

If your employment is terminated and you have to leave the country I do believe they cannot penalize you on the rent contract. If you show a cancelled RP you should be able to get out of the contract immediatly. I would definately speak to them about this as I am sure it is against the law.

A standard contact always has a clause where either party can terminate a contact with 1 or 2 months notice

You are right about the landlords need some protection like a fair notice period. One month is the best a tenant can get. 2-3 months at max. But not the full year :)

Anyways, they did agree to sign a separate letter specifying conditions of breaking contract, with 1 month penalty in case of termination of employment and 3 months for any other reason.

The company is Al Emadi. Well i did sign up hoping that since its a good name, there wont be any trouble later.

This clause definately is very strange and i think quite unfair. However i asked around and half of the responses i got was that it is normal, the other half said they never heard of it :)

so anyways, the apartment was too good to leave and i took it

Me too PM. As I said I was able to do it once but paid 3 months rent to do so, and we can do it in our current house because the owner is gagging for us to move as the villa beside ours is double what we are paying.

Same here as PM. I have moved about 8 times in my 11 years here and each contract only gave a termination clause if I was leaving the country. If you think about it, you have agreed to sign a years contract (sometimes 2) and in 2 months found a better price. This doesnt offer much protection to the landlords to be honest and would make it redundant to sign a fixed term contract for any reason other than the renter securing the rental rate.

The lowest notice period I ever had was 2 months, but I ended up paying for 3.

Which real estate company are you dealing with rock? because even we happedd to come across the same clause in our contarct which we signed a few days back..that if we want to move out we have to pay the rest of the amount.Even we were confused on this clause.I guess its a new law....but when we approached a legal advisor he said its normal and nowadays almost all real esate companys have this clause and that in most cases if we give 1 or 2 months of prior notice we don't have to give the full payment.They are just making their side safe.

Normally the contract says" You can break the contract by providing 1 or 2 or sometimes 3 months notice to the landlord' If you fail to provide the notice, landlord will charge you the rent for the notice period.
