Is the marriage valid??
By qatar.doha •
Hey,
My friend just got married, She had been civally married for 1 year and now they got married in the church.
She recently found out that her civil marriage certificate is not valid, as her husband had a previous marriage and he was not legally divorced when they got married
So does her church wedding stay valid, or does that mean that they are not married at all???
Please please help me.
Thanx
He was finally divorced from his first wife in May of 201*. However was not aware that the process was ongoing, so he n my friend got married in March of 2009 in the civil court in india.
N now they got married in the church in 2010...
So i am pretty sure that their civil is not valid, but what abt the church??
no, their marriage was never valid eversince because his husband is not yet annulled or divorced. Your friend's husband has then committed BIGAMY.
In most countries, what he did is considered illegal. In most civil marriage ceremonies, you're supposed to sign an affidavit of single status, which is basically you declaring that you're single and free to marry. If he signed that document while being married to somebody else, that is illegal.
Basically, their marriage is not valid. Period.
Without any due process to cancell the first marriage contract through divorce before second marriage, it is invalid and so called BIGAMY.
I agree bestman, however if their Civil wedding was not valid because he was married, then the following questions could save her the cost.
Was he divorced (fully) at time of Church Ceremony. If answer is No (still married) then No the wedding is not Valid.
If the answer to the above is Yes, then was the Church Ceremony a Fully licenced wedding or a Blessing of the invalid civil wedding. If the answer this is it was Blessing then No the wedding is not valid.
So if he was divorced and the church wedding was a full wedding then chances are it would be valid, but given the history professional legal advise is advisable.
If however he was not divorced, no point wasting the money, it wouldn't be legal, and if it was only a blessing then again no point wasting the money as that is based on the illegal civil wedding when he was still married.
Better to check with Scholars then QL
was he divorced at the time of the second marriage and was it a full wedding (with licence, register, etc) or was it just a blessing ?
I think the marriage isn't valid, she might wanna see a lawyer about that
