Doubts regarding new labor law

Doubts regarding new labor law

There area so many confusions with the new amendments to the labor law

1. The new law says that the employee has to apply for EXIT permit directly to MOI 72 hours (3 days) before his scheduled departure, because they want to check whether the applicant has any violations, criminal offence, or any legal cases against him.

Under this circumstances, if he wants to exit country withing few hours, how would it be possible? Should everyone  wait for 3 days? In conclusion , the old law is much better.

Note: Under the new rules, Still employee need approval from employer at the time of leaving for good

 2. If the contract is "limited" then any one can change their profession at the end of the contract period. If it is "unlimited" he has to complete 5 years wit his existing employer. Now the question is,

a) if he wants to change his job within 5 years what are the rules ?

b) Does he still need the NOC to change job within 5 years of term under "unlimited Contract" ?

c) If he cancelled his visa before before completing 5 years and he go back to his home country, now can he come back with in 6 month or after 6 month or after 2 years?

Still the New Labor law is lacking in the following areas. No Information about

  1. Labor complaint desk 24X7
  2. Wage Protection Scheme
  3. Minimum fixed salary for each lever of profession
  4. Basic salary percentage
  5. Annual Leave pay should be 30 days instead of 21 Days
  6. Periodical visits of MOI officials to companies to ensure the amendments of new rules

I am expecting some good advice and views from QL readers.
