When it's not stated on the contract, will the employee receive gratuity after his years of service/contract?

to get gratuity you must complete at least 365 days(1 year) in employment with the employer.

The contract is a legal document which is attested by labour office so ESB(end of service benifit) is payable to employee. however if employee resigns before termination of contract, it depends on terms of seperation rules of the company.gratuity is calculated on basic salary only

All ESB's are paid as per the Qatar Labor Law.

note that the gratuity took effect by law only in Jan 06. contracts should have been changed to include that as a labor dept requirement. if not, pursue the matter with your HR first. the Labor law is available in bookstores or downloadable from the net. use it as proof to convince your HR, then your employer, to include that. good luck.

However, Employer may argue that its not mentioned in the contract. Better, ask them to amend now or u'l have to get into the hassle of filing a case later.

i doubt... if you will get one. sometimes company(specially small one's) purposely removed that paragraph in the contract so you cannot get the benefit of it. you may file a case thru court but definitely it will be time consuming which will only lead you to more stressful life! goodluck!

Gratuity is must as per qatar labour law, if employer says will not pay then you have to file a case in Labour dept. defenetly you will get. You have to complete atleast one year to get gratuity.
