3 month salary pending

Dear friends,
working for a engineering consultancy company, my sponsorship under this company and my job category less what i do actual, since 3 month salary pending with the company (receiving via bank), if i request salary they say insha allah, allah kareem,next week ( at any time) , is it ok to file a case in labour department and ask for NOC and salary?
