Yemeni girl, 8, gets divorce after forced marriage
SANAA (AFP) — A Yemeni court on Tuesday granted a divorce to an
eight-year-old girl whose unemployed father forced her into an arranged
marriage this year, saying he feared she might be kidnapped.
"I
am happy that I am divorced now. I will be able to go back to school,"
Nojud Mohammed Ali said, after a public hearing in Sanaa's court of
first instance.
Her former husband, 28-year-old Faez Ali Thameur,
said he married the child "with her consent and that of her parents"
but that he did not object to her divorce petition.
In response
to a question from Judge Mohammed al-Qadhi, he acknowledged that the
"marriage was consummated, but I did not beat her."
Yemen, one of the world's poorest countries, has no law governing the minimum age of marriage.
Nojud was a second grader in primary school when the marriage took place two and a half months ago.
"They
asked me to sign the marriage contract and remain in my father's house
until I was 18. But a week after signing, my father and my mother
forced me to go live with him."
Nojud's father, Mohammad Ali Al-Ahdal, said he had felt obliged to marry off his daughter, an act he claims she consented to.
He
said he was frightened after his oldest daughter had been kidnapped
several years ago and later married to her abductor. He said the same
man then kidnapped another of his daughters who was already married and
had four children, resulting in him being jailed.
Dressed in
traditional black, Nojud said she would now go to live in the home of
her maternal uncle and did not want to see her father.
The girl's
lawyer, Shadha Nasser, said Nojud's case was not unique. "I believe
there are thousands of similar cases," she said, adding that civil
society groups are pressing parliament to set the minimum age for
marriage at 18.

I think the father has a mental problem. However, a Qadi should decide the best way to make him understand that what he did was wrong. If his mental problem is not severe then perhaps some discipline is in order for selling his daughter. (which is haram).
The imam who married the girl has committed a sin by not being aware of the condition of her walee. As a walee must posess certain characteristics that allow him the authority that comes with the role.
Also the girl must give her express consent to such a marriage. And I cannot see this happening with a 28 year old. The imam should have felt something was wrong at this stage however he failed in his duties and this young girl has paid the price. I believe he should be stripped of his title at the very least and made to pay a fine. (and his own personal life thoroughly investigated).
And yes the two witnesses are also to blame. However, in a functioning islamic society they would have been put to blame for not reporting the incidence and making sure the girl consented to such a marriage. Part of being a witness is that one signs their name agreeing that this marriage meets all islamic obligations. And the two witnesses have failed in this regard and given false testimony.
But I believe the worst in this situation is the goverment. Who has failed to establish an Islamic system which would prevent (as much as possible) such injustices. And I am at least glad that she has been allowed an anullment. My only worry is the character of her uncle has not been properly investigated. May Allah keep the girl safe from harm and strong with what faces her. InshAllah alahumma ameen.

I can see how they're different with respect to family names. But biologically speaking, genetic diseases have the same chances whether uncle's son or aunt's son, they are both the girl's first cousins, so they both have the same degree of relativity. So genetically, the aunt's son and the uncle's daughter are the in the same genetic clan as the uncle's son and the uncle's daughter.

See, my paternal Uncle's Son is having the same family name as of mine. I.e. genetically we belong to the same clan. Whereas if one marries paternal Aunt's son the family becomes different having different genetic clan...and a chance of genetic mutation is likely.
I must clear that if I am a boy, I can't marry to my Paternal Aunt's Daughter. Only paternal Aunt's son can marry to his maternal Uncle's Daughter....hushhhhhhhh too much complicated family business...lol.

We call Father's brother's son as first cousine and not allowed to marry him. Whereas if he is Father's sister's son then marriage is allowed.

Excuse me Thexonic, but get your facts right. Brother-sister marriage not done with blood relations. I.e. In India you can't marry to your blood brother or blood sister. Man's sister's Son can marry with the same man's daughter and this is far away a blood relation.

Oh yeah I've seen that movie, very sad indeed. She dresses up as a boy just so she can learn (girls weren't allowed to go to school) and when they find out she's a girl, they decide to kill her but then the 80 year old man tells them that he'll marry her instead. There was a scene where he's riding on a cart pulled by a donkey and she was sitting next to him with tears in her eyes, it broke my heart. I wonder if being hung've been more merciful

Well Alexa, in Cleopatra's time, uncle's married nieces, and brothers married sisters. In India during the 1860's girls aged 8 and 9 used to get married. I'm sure there were child marriages in the West as well a long time ago. With time, those societies has progressed and evolved and began to realise that it's wrong; however, small tribes in Aghanistan or Yemen or other secluded poor places did not. If there was no exchange of ideas and opening up with other countries and cultures, how can u expect them to change or evolve like the rest of us? They've been doing this for generations and have not known anything else. I'm not justifying what they're doning, just trying to understand it.

I saw a similar article on the BBC today about and 11 year old being married of to her fathers cousing for $800 so the family could afford to buy food.

the youngsters and wants to strip their parents of custody and put the
children in foster care or up for adoption.
The raid followed a call to a domestic violence hot line from a
16-year-old girl who said she was beaten and raped by her 50-year-old
husband at the compaound.
Of the 139 women who voluntarily left the compound with their
children since an April 3 raid, only those with children aged four or
younger were allowed to stay with them, said Children's Protective
Services spokeswoman Marissa Gonzales.
"It is not the normal practice to allow parents to accompany the
child when an abuse allegation is made," she told the Associated Press.
The mothers were taken away yesterday after they and the children
were taken by bus under heavy security out of historic Fort Concho,
where they had been staying, to the San Angelo Coliseum, which holds
nearly 5000 people and is used for hockey games, rodeos and concerts.
Some of the children's mothers told Texas Governor Rick Perry that the youngsters were getting sick.
About 20 children had chickenpox, said Sandra Guerra-Cantu of the state Health Department.
The sheer numbers left the judge in the case perplexed yesterday as
she considered suggestions from the lawyers for how to handle a custody
hearing on Thursday.
"Quite frankly, I'm not sure what we're going to do," Texas District
Judge Barbara Walther said after a conference that included three to
four dozen lawyers either representing or hoping to represent
youngsters.
Texas bar officials said more than 350 lawyers from across the state
have volunteered to represent the children free of charge. As well, the
139 mothers who voluntarily left the sect to be with their children
need lawyers to help them fight for custody.
The sect practises polygamy in arranged marriages between underage girls and older men.
The group has thousands of followers in two side-by-side towns in Arizona and Utah.
The sect's prophet and spiritual leader, Warren Jeffs, is in prison for forcing an underage age into a marriage in Utah.

The other day...I was talking to an old Iranian man in the office, he told his son made an accident back home and he is underage and don’t have a license so he will be in the jail for 6 months...I asked him if his son is studying? He told no his wife is studying? I was like.... what? he said..yea.. he got married at 16 and stopped studying...his wife is in grade 9th..... Its sad to know such things happening in different parts of the world....but a boy marring at 16 with parents permission is even more strange....

countries outside Africa.
