working accident in Qatar

Hi eveybody
I post this subject to ask for your help about the Law in Qatar. I am doing the recruitement business, sending Vietnamese worker to work in Qatar
5 months ago, I send some Vietnamese workers to work in the Bard El Hazerk in Qatar. But on the 3/3/2007, one of my worker had accident at work site and lost 1 eye. The company afetr take him to the hospital to save his eye but can not, now his eye is lost 100 %. After that the company did not give him any food, salary or compensation for the accident. I call up the company so many time but they said have to wait.
It has been 6 weeks since then, the last time I called, they said that I have to contact my Embassy , and the Embassy will contact them . I think that the company did not buy the insurance for the oversea labour, and I will go to Qatar next week to help my worker.
I would like all of you give me advise,
what should I have to do?
What document I have to prepare ?
The address and telephone number of the Labour Department in Qatar?
If I have to take them to the court, who is the best Lawer in Qatar that I have to contact and how much the cost will be ?

Take this up with both the Labor Dept and the Qatar Human Rights Commission.

I mean his Personal Protection Equipment or what ever that is. It includes safety shoes, helment & could include protective glasses.

If the Company hadnt issued one to him then you definately have a case. But if they had given the equipment but he failed to wear them then it would be difficult for him to press the case.

But he could still claim negligent atttitude of the company as he had to go to an unsafe place without safety equip. & without insurance. and after the accident totally neglecting him. A case against the co. could save such accidents in the future.

I am really touched by your efforts. Keep it up.

A point worth asking is who was actually employing the individual?

Was he employed by the Qatar company or was he on contract to them. from the parent company? Surely, this would affect who is the party liable for insurance.

I feel sorry for your worker.I would like to give you this information taken from Qatar labor law.

Article(109)

The worker who sustains a work injury shall be entitled to receive medical treatment appropriate to his condition at the cost of the employer in accordance with the decision of the competent medical authority. He shall receive his full wage during the treatment period or the period of 6-months whichever is nearer. If the treatment continues for a period exceeding 6-months, the worker shall be paid half of his wage until his recovery or proof of permanent disability or death or whichever is nearer.

Article(110)

The worker who dies because of the work and the worker who SUSTAINS A WORK INJURY resulting in a partial or total permanent disability shall be entitled to receive compensation..........

Article(113)

The right of the worker to claim compensation for the disability or death shall extinguish by the lapse of 1-year from the date of the medical report containing the occurence of the disability resulting from injury..........

Since you are coming to Doha, the best place you contact first is your embassy to seek assistance.

Second, your worker needs a MEDICAL REPORT from Hamad Hospital and POLICE REPORT which contents a brief description of the incident. He may need also a witness to sign and testify the accident(can be one of his colleagues at the site).

Third, the address of Labor dept. at Almuntazah area along C-ring road just besides American Hospital.

Fourth, sorry i cant help you w/ the best lawyer, you can ask assistance from your embassy in this. And you may also want to know the degree of disability of your worker: Loss of vision in one eye(completely)= 50%
