A new excuse

Miss Mimi
By Miss Mimi

So if you ever find yourself accused of raping your maid, here's an excuse that appears to work:

Man who denies raping maid 'as wife is prettier' wins appeal

ABU DHABI // A teacher who denied raping his maid saying his wife was "much prettier" was cleared by an appeals court today.
The Jordanian RM was accused by his Filipina maid, LA, of raping her while his wife was at work and his 13-year-old son was playing computer games in his room.

The Criminal Court of First Instance sentenced him to a year in prison followed by deportation. However, this was overturned by the Abu Dhabi Appeals Court which found him not guilty.

The man's lawyer, Fayza Moussa, had previously rejected the rape accusation saying her client suffered diabetes and was "sexually weak". She said that this had prevented him from sleeping with his wife for four months prior to the alleged incident, and questioned why he would be any less impotent with the maid when his wife was much more beautiful, attractive, and 12 years younger than he was.

Ms Moussa asked for the wife to be shown to the court, so that judges could see how beautiful she was.

She dismissed forensic reports that found traces of the man's semen on the maid's underwear. She also commented on the size difference between her large client and the petite maid.

"If he had held her against the wall while raping her, as she had claimed, there would've been some marks at least from his fingers on her body."

Ms Moussa said the maid had made up the rape to spite the man's wife who scolded her a lot.

Actually Shisha, it might count as assualt. It's a huge violation of privacy, especially if she was then wearing them!

the bigger issue isn't about this exact case or what the judge did or didn't deicde and why: this is not the first story we've heard about like this in this region. Why is that?

By dota• 22 Mar 2012 11:34

Ok I m not saying she was not raped becuase there were no marks it can be intimade partner assualt or he just pointed a gun on her head and raped her but there is just not enough evidence in this report. Its a high court in emirates and I m sure the judge was qualified and didnot base her decision on the excuse wife is prettier

There are many kinds of rape-- in fact, it's estimated that around 80 per cent actually fall into the category of 'intimate partner assualt' meaning it's someone the victim knows, and may in fact have had a sexual relationship with before or after the rape. rape is not always a violent attack by a stranger-- and it sounds like this was the case here. You cannot simply say 'oh because she wasn't beaten or isn't torn to pieces it wasn't rape'-- the advice most police and other advocates gives to women is to not fight, if it will save them from harm. I'm not sure of the stats in the GCC but I do know it's estimated by Statistics Canada that 1 in 6 women in university or college in North America will be assualted, but only a tiny fraction of those will be reported-- mainly i think because of attitudes like this.

We need to start teaching men that this is NOT acceptable. That it is NOT ok to demand sex from anyone, even if it's your wife or girlfriend, or to force any sort of unwanted and unwelcomed contact on them. Even if all he had done was rub up against her until he orgasmed, that would still be a trauma and is still assault! There's a great movement that started in Canada last year, Slut Walk, after a police officer actually told a campus full of students taht if women didn't dress provocatively they wouldn't be raped (!!!). check it out at www.slutwalktoronto.com. It's basically a series of marches all over the country to say that no matter who you are you do not deserve to be sexually assaulted, ever. We could use something like that here.

I'm not going to even bother debating the report as clearly certain folks in this thread like to blame the media for absolutely everything, allt he time, and it's off topic anyway.

There is just not enough evidence and information in this case or atleast in the post to prove the man guilty in any judicial system in the world. And the reporter just presented the story in such a way that we will question the decision

I think the sad thing is the judge and the man's defense got so wrapped up with this nonsense of "my wife is prettier" and "I have diabetes so therefore can't get it up" that no one will ever know if he did ACTUALLY rape her.

I can't believe the judge even listened to these excuses, rather than calling for real evidence.

Well may be the guy was just wearing maid's pant, then forgot to take them off and had an accidental orgasm in his sleep.. :P

Its pretty clear from the report that he just got away because of the smart lawyer he hired and a weak judicial system.. coz the evidence proving he's guilty are way stronger than the ones for his defense.. My opinion :)

max1986: No No No! i beg to disagree! The report says the Judge based her verdict solely on the no coercion marks on victim’s body and coz his wife was prettier than the maid.

Y is everybody sure that the man did rape maid? Only based on the evidence that there is semen on maid underwear. Maybe the man just commited adultery but not raped the maid as there r no sign or mark of struggle and forced sex. And ofxourse the judge didn't based her decision only on the factor that man wife was prettier. And this man is a jordanian expat not a emarti

Looks to me like he did it, and got away with it. And now the maid has been raped and also branded a liar, the poor girl.

Doha chap: muddying the waters much??

And, just so you know, it wasn't the media who were fabricating the reports: it was the people in power providing them. Media reports the facts as we understand and fact check them. At the time, that is what was believed to be true, and the reporters reported it as such. I think you're lumping ALL media in with pundits, opinions, and talk shows, and heaping all the blame on the media.

Also, this IS NOT a thread about whether or not media 'lies'. It's a thread about a horrible thing that happened that the officials in the UAE are happy to ignore, and about the clear status of women in this region.

Methinks you don't want to believe this jordinian did this, but you don't want to blame the maid as you KNOW you'd get slammed for it. So you blame the big bad media instead. If you don't believe the boss raped his maid, jsut say it.

Shisha, that's actually the problem. I mean, heck, I keep reading thingsa bout the movement of late in Morocco to make them repeal a law that allows rapists to marry their victims, in order to spare the victims family shame!

The fact that this law EXISTS and there is even any debate at all about repealling it says a lot about the status of women in this region. It's a shame, too, because in other areas, this region is making great strides towards gender equality. BUt then they have to go and ruin it with these medieval ideas about sexual violence.

Doha chap, sounds like you're on the side of the rapist.

You seem to be confusing blatent fabrication with bias. Those networks you mention are indeed biased: they cherry pick what they report and how they do it. But, they do not create this news out of thin air. Neither does the National, and in stories like this that are critical of the judiciary? i doubt they're letting bias slip in-- quite the opposite.

Now, can we stop debating the merits of journalism and get back tot he ridiculousness of allowing a rapist to go free because he claimed his wife was prettier than the maid?

DC, the paper was quite clear it was the purpetrator's semen in her underwear. ANd good journalists know that when reporting criminal cases, the laws are quite strict (and even in places where they might not be totally enforced, most good journalists will still adher to these rules as it's a matter of ethics) about privacy and what you can and cannot publish. Most of us won't, for example, publish a victim's name, and will refer to the purpetrator as 'the accused' or 'alledgedly' until they've been found guilty.

Stop blaming the paper for this: they didnt' make this up, this actually happened, and you should be appalleda t the judiciary and this man, NOT at the paper for reporting it! Why on earth would they make such a thing up? the national is not some tabloid!

More importantly: even if he had just jerked off on her underwear, that could still be considered a crime. Assault isn't just full on penetrative sex you know-- any unwelcomed contact is a violation.

By Formatted Soul• 22 Mar 2012 09:46
