An eye for an eye

A Saudi judge has asked several hospitals in the country whether they could damage a man's spinal cord as punishment after he was convicted of attacking another man with a cleaver and paralyzing him, the brother of the victim said Thursday.

Is this not inhumane?

its definitely inhumane and such things happen only when there is no penal code in the country. the punishments are guided by sharia laws and thus left to the interpretation of judges..

unfortunately, the guy suffered injuries and became paralysed..however, there was no specific intention to paralyse him...it happened by chance.

hope the judiciary also think on these subtlities to..

he should be tried for 'intent to murder' and probably should serve a life sentence.

This is a hard one..

An eye for an eye concept is also clearly stated in the Bible, but obviously not practiced.

Having lived and worked in Saudi, I personaly feel that the Judge is "playing along" and will render a judgement to the effect that this punishment is not possible since one cannot guarantee that an operation will secure the same result.

garce, let nature take it course

it means the victim tribe will kill at least 1 guy of the others tribe, so this judgment applied well

and if the victim forgives he will be very good, and human

This act is inhuman and only done during primitive days.

Let nature take it course to punish the criminals, for not sooner than they think the wrath of justice shall fall upon these criminals.

So.. why stain your hand with blood of criminals?

We dont have the enough islamic knowledge so let the Ulma`a decide.

For those who think the Judge's decision is inhumane, let me ask this, what if you were the victim in this case, how would you feel?

Regardless where this case is, if it was me, I do not want to spend my entire life on a wheelchair when someone causing this to happen is dancing out there.

In Saudi, some of those cases end up by forgiveness because in Islam, if you forgive when you are able to execute, God will reward you a lot. For example, many cases of murder end up in forgiveness just before the minute of execution. This is widely common in Saudi, and the killer would spend their entire life making up for their crazy act. In many ways, that is possible.

But, an eye for an eye and a tooth for a tooth is justice. If that is really implemented, you will see many VIPs in our world behind bars.

drmana, if you would ask me, i would call this as an INHUMAN act and un-acceptable atleast with the idealogies of my life...

dramna, how we can't talk about the personal emotional reaction here ?????

it is the most important issue here.

this law is to prevent such of excessive reaction as i said before

saeed, yes i can relate myself to this incident coz i too had suffered a MAJOR ACCIDENT due to one's neigligence and i am stil paying for it with a severe ankle injury on my leg..I know what does it mean coz i have suffered a lot..

But i don't want same JUSTICE for the accused that did this to me..

By drmana• 20 Aug 2010 13:32

saeed khan, we are not talking about personal emotional reactions here. It is about the law which such be rational and above human reactions I believe.

but do you know what is the sad thing?

everybody?

that the law is only applied on poor people, and the people in power are protected from the law in all the world, and this is what god told us about "the reason of general punishment"

By soniya• 20 Aug 2010 13:28
soniya

saeed, are you serious?? But we really oppose such kind of laws back to our country..and u too belong to same..right???

"Law in Saudi Arabia allows defendants to ask for a similar punishment for harms inflicted on them."

It's been written in the article..If this is their law, i don't think the accused will be spared now..

now let us see what the quran says about it

,,,,,,,,,,,

O you who have believed, prescribed for you is legal retribution for those murdered - the free for the free, the slave for the slave, and the female for the female. But whoever overlooks from his brother anything, then there should be a suitable follow-up and payment to him with good conduct. This is an alleviation from your Lord and a mercy. But whoever transgresses after that will have a painful punishment.

178

And there is for you in legal retribution [saving of] life, O you [people] of understanding, that you may become righteous. 179

,,,,,,,,,,,,,,

albaqara

http://tanzil.info/

we find many point here

1-legal retribution: no one can do it by himself

2-equality in the judgment.

3-forgiveness is much more preferred.

4-opening the issue after forgiveness is the worst , and god will punish him by himself.

this kind of judgment will save a lot of blood among people of what they call "Revenge"

5-this kind of

I am not in favor of the punishment.

If the intention is to to paralyse a person, all they need to do is to whack him hard enough at the required area. If it does not work, just whack again.

Cheaper and more effective.

Romans 12:19-21

Beloved, never avenge yourselves, but leave it to the wrath of God, for it is written, “Vengeance is mine, I will repay, says the Lord.”

and now and in many areas of the world, you see that if a man kills a man, a war happen between the families to take the revenge.

Actually, dramna , this law is very old made by hamourabi in baybalon.

but let us think logically about

this law was made to prevent the EXCESSIVE REACTION by the family of the victim.

especially for tribes.

for example when you know that arabs before the coming of the prophet by 50 years or something, she kept fighting for 40 years for a camel, and a lot of people died for that reason and another series of battles occurred for killing a man

look dramna, if the criminal think that he will face the same destiny he will not do it , but he was thinking that he will spent couple of years in prison then go out, the total thinking will change

One-shot, I do, very much....the victim must be suffering a lot and so must be his family. But to punish the guilty by the same is not the way in my opinion.

wrongly accused happen in everywhere, not only in saudi arabia

and they send to death or spend there lives in prisons by crimes they didn't do,

but this is not the issue.if he was accused wrongly.

this is a different issue

By FathimaH• 20 Aug 2010 12:52

Only in cases of murder? This man was injured bad and the accused should definitely be punished for his crime but is this sentence Islamic considering the fact that the victim is still alive? I'm open to correction here but please state the proof from the Quran and sunnah that Islam permits eye for an eye in situations like this where the victim is badly injured but still alive with a chance of recovery and survival yet as after all as long as he lives Allah can cure him just as he brings life to the dead.

By drmana• 20 Aug 2010 12:52

He may or may not be guilty...but surgically causing paralysis to any human as a punishment is cruel whatever the justification. Living a paralysed life is worse than death.
