Employment Termination

Hi All,

A friend of mine left the country and went on annual leave, but was terminated before before he could return. The reason for terminating him was because he did not resume duty on time. The problem is that he has a bank loan and his formal company is refusing to pay him any end of service benefit inorder to settle his bank loan. As I am writing this post, he is still outside Qatar and is willing to comeback but could not because his visa has been cancelled. Please, what is your advice for this my friend and what necessary steps can he take?

Your friend is both a thief, and a moron. Did he really expect the company to pay him the money that he owes the bank? How are some people so lacking in simple ethics and morals. He's lucky the bank hasn't sent a collection agent after him to recover all the money.

1. the loan is sactioned from the bank will be upon the no objection letter from the sponsor. according to the NOC letter the sponsor taking the liability only to tranasfer the end of service benefits to the bank when the beneficiary did not settled it. (this is happened here)

2. he can come here back even he is terminated untill stamped the "cancelled" in the visa page of the passport(passport is in his hand now)

khalli, in our company, the following is written on the salary certificate:

"I shall not hold the Company liable should the Bank lodge a travel ban with the Qatar Immigration Department and/or enforce any other contractual or legal right, remedy and/or sanction against me as a result of my failure to pay or settle any loan, monies and/or charges owed by myself to the Bank under or in connection with the above-mentioned credit card, loan or other credit facilities at any time during or at the end of my employment with the Company;"

so sponsor is not liable.

No , no , a sponsor is not a guarantor to its 10,000 cunning fellows who just come to gulf to take easy loan and take off to disappear in 15 months or so .. ................... next time read a letter which sponsor gives to a poor soul who goes to a bank for a loan ............ ... Pilot , How is that , an employee { A person } took the loan not the company , so how can a bank discuss somebody else's financial deals with the other entity who did not see any money ! First of all you said the reason for terminating him because he did not resume duty on time , how can he resume duty when he is still on vacation ? Second terminating for simple reason such as this is stupid. I don't believe a company will terminate him for that simple reason a company will only subtract from his salary such amount prior to the day's lapse according to his return date. Now If he is terminated then that is not the only reason there's more than that. If that is the case , and visa is cancelled he can still come back here with the new kafala system but he has to call the bank and let them know the whole situation and company as well , he has to convince them that he is willing to come back and settle everything .
