I was thinking along the lines of King Solomon and the baby when I said old fashioned. I for one am with justice. I wouldn't want someone to be punished excessively just because I'm emotionally distraught.
I dont know how a view on a justice system can be old fashioned or new fashioned... justice is justice at the end of the day irrespective of times. However, whether it was fair earlier and whether it is fair now... I dont think it was fair then and it is fair now... so in all probability revenge still seems ones best bet... atleast it would be satisfying that one did what best it could do within its means.
I think that's a pretty old fashioned view. I can't see too many people being happy with being sent to prison or executed, and I don't think it's possible to make victims happy either. I think a fair judgement is what's BEST for both parties, regardless of whether they agree it's fair.

Casey Anthony is an unfortunate byproduct of the system. For the hundreds of innoncent people who are rightly released for "failure to prove beyond a reasonable doubt" there will be the minority who get away who are possibly guilty. After looking at the facts in the case, I sympathize with the jury, it must have been a very difficult decision, and I'm not sure I would have made a different one. I think perhaps if the prosecution hadn't tried to go for the death penalty it may have turned out differently.She however is a prime example of why we have courts to decide these things, why should emotionally charged strangers hold a persons life in their hands?
When people have the justice they are seeking for they could either stop thinking about revenge and go on with their lives or still take revenge bec.they are not satisfied with the punishment given to the criminal.. There are really people who believes in "an eye for an eye,a tooth for a tooth"..I heard many cases where the victim's family get justice but the criminal being sentenced for a couple of years was shot dead.. I don't think that people get contented, the demands and wants are always revolving..anyway,contentment dpends on every person..one can get contented but it's not always the case for some..
It seems that revenge and justice can never complement each other... Unlike in movies, wherein the good guy finishes the bad guy as an act of revenge, we say 'Justice done!'... But when the same plays in real life, we say 'the law must take its own course'

Justice is about fairness, whereas revenge is about satisfaction for the victim.
For example: Rizks spills Karak Chai on my new Armani summer pajamas with the built in padding. Justice would be served if he bought me a replacement pair and apologized. Revenge would be sweet if I could tie him down and do the same with extra hot and sweet chai :O)
And justice, in trying to be logical, doesn't give the offended what it deserves...so still feel revenge is better than justice as atleast it makes me satisfied.
Could it be that revenge is when a victim retaliates, and justice is when the system retaliates on the victims behalf? Just a thought. Other than that LP's equation looks good to me.
Revenge only takes your side of the story, and your feelings into account. At it's core it's selfish and illogical. Justice takes in all sides of the stories, everyone's feelings, and tries to be logical.

As per my understanding a judgement is only that much fair as much it can satisfy both the parties, if it cannot it isn't fair.
Oh I think there are fair judgements, but not in the eyes of the victims. Which is why we don't let victims decide the judgements.

In rhe above case, she was found NOT guilty by a jury, yet outsiders want revenge for the death of her child..
Such is human nature .. Look at the recent case of Casey Anthony murder case.. Justice has been served, yet people are wanting revenge :O(

Somehow, we as a society are moving towards 'revenge' rather than justice... Has the legal system gone kaput, or is there still hope?
