5 Years Gratuity

Hi to all, I'm six years now working my company can i get my 5 years gratuity pay from my company? Any labor law related to it? Thanks for your help.

In above some person has written "30 days once you complete 5 years, otherwise 21 days. it is article 54. later it is added that 30 days after 5 "

Can anyone explain with the article no of Qatar Labour Law.

Because i do not like false statements, i believe in proofs only.

 Article (54) In addition to any sums to which the worker is entitled to upon the expiry of his service, the employer shall pay the end of service gratuity to the worker who has completed employment of one year or more. This gratuity shall be agreed upon by the two parties, provided that it is not less than a three-week wage for every year of employment. The worker shall be entitled to gratuity for the fractions of the year in proportion to the duration of employment.   The worker's service shall be considered continous if it is terminated in cases other than those stipulated in article 61 of this Law and is returned to service within two months of its termination.   The last basic wage shall be the base for the calculation of the gratuity.   The employer is entitled to deduct from the service gratuity the amount due to him by the worker.

 Qatar: Pay on time, Ministry tells private firms admin | News, News & Information | January 4, 2011 DOHA: The Ministry of Labour yesterday asked private companies to strictly abide by the labor law and said that workers who have completed five years in a firm are entitled to 30 days of basic salary as end-of-service benefits for each year of service put in after that period. And up to the first five years, a worker is entitled to only three weeks of basic salary as end-of-service benefits for each year, and the basic salary is to be calculated on the last (basic) salary drawn. i want to know also the bases of this one

Hi, Could you please tell me where it officially says that the Gratuity is calculated on 30 days after 5yrs service? As per article 54 it says only 21 days nothing about 30 days? ThanksAjesh

30 days once you complete 5 years, otherwise 21 days. it is article 54. later it is added that 30 days after 5 years.

it depends on your company,some give if you reach 5 years & some in your end of service.

can we find this on Qatar Labor Law, which specific article? because our HR is asking for the article number of the law.

It is upto your company to decide if they want to pay you on your current salary for your service sofar but they have to give you the difference if the basic salary is increased during the remainder of your service.

Some companies follow the pattern to ease cashflow but if there is a dispute (labour deptt) they have to provide full calculation plus paper work.

Gratuity is termed as EOS (End of Service) benefits and can only be availed when one leaves the organization (termination/resignation)

As per QLL, for the first 5 years gratuity is calculated on the basis of 21 days per year (some companies give it @ of 30 days irrespective of the no of years)and if one exceeds 5 years then gratuity is calculated @ 30 days per year.

Some companies even allow their employees to take their gratuities yearly (if the employees so wish)to reduce their liabilities.

Im also leaving my coming by end of this month and im claiming my end of service but my company HR manager is asking me to submit the solid proof that company should give 28 or 30 days end of service after 5years completion. Please, clarify or tell us the rule or proof.. tnx

well for information of all !!!!!!!!!!! as per Qatar labor law if you complete 05 years in a company, you are eligible for gratuity equivalent to 30 days salary for each year you served in the company.

jackmohan means that since you have already completed your 5 years in your company, you can now get your gratuity in advance even if you are not yet leaving your company as he has seen in some other organisations that they can receive or withdraw their gratuity every 5 years...

Yes you can.

In other countries its end of service benefit... but here I have seen 5yrly withdrawal in Govt and non govt organisations.

no...u can only get gratuity once u leave the company.
