Fired by company, what to do know
Hello, my name is Aysha en im asking this question for my husband, cause he doesnt have internet.My husband is Sri Lankan en came to Doha trough a agency there.He started to work in Doha with a company and worked in a clothesstore.He worked everyday without even one day off, en worked 11 hours a day non stop, yesterday he got words with the direction about the long days en the money they promised him he didnt got, they payed him only half. After these words they fired him.
What to do now? They told him to wait till the company contacts him, but they didnt tell him when.Do they send him back to Sri Lanka en does he have to pay the 1000 dollars cause he didnt make the year full? en how does he come back? Or can he go en find another job in Doha without going back first?
Pf everything is so fucked up en we really dont know what to do?
I hope we can get some usefull advise here,does anyone have experience?
It all feels so unfair,
You come as guest workers in a foreign country, you allready know that wages are lower for you , but that aside, you know which choice you made. (mis)used by the company you work for, working too many hours that are severely underpaid, making consecutive days of 11 hours and not get a day off, because u didnt build it up.The contract said 48 hours a week,he made at least 65, en then u get the paycheck en u get not even the have of what they promised to pay. and then you say some of this, fight for u right, you fight and you get fired. they have your passport, you can not move and are totally dependent on them.
I know my husband is not the only one that is happening to, but this is so frustrating.

Release: The employer agrees to let the employee find a new job and "Releases" him/her "with" the visa. Here the new employer doesn't have to apply and obtain a visa for his new employee, only a transfer of sponsorship takes place.
NOC: The employer doesn't "Release" the visa but signs a document (NOC) required to be produced in immigration by the new employer for a visa in his new employee's name. In this case the employee has to take an exit and re-enter Qatar on the new Visa.
Normally releasing is not in the interest of the employer since the same visa can be re-issued in the name of someone he hires and avoid having to apply for a new visa, paying the fee etc. Moreover visas for certain countries are difficult to obtain.
Whereas giving NOC doesn't affect the employer in any way unless he holds some kind of personal grudge against his employee.
Notably the employer is not obliged to give either Release or an NOC to his employee unless some agreement was reached before signing of the contract. :)
infact both are same, she couldn't know the diffence between two while commenting on....
flexicode, how release is different from NOC? and why the employer wouldn't give "release", but would give a "NOC"? could you please enlighten me on that?
better for him to ask for the release to the employer, he can find job somewhere which isn't a big deal...
The employer terminating the contract must normally pay for his one way ticket to his home country. If he doesn't get this he can move court. He must also get at least fifteen days notice.
Things he can do now are...
1 Request for a release from the employer. If the employer refuses...
2 Request for a No Objection Certificate. If the employer agrees then he will have to find himself a new job and re-enter Qatar on a new employer's visa.
3 If the current employer refuses both, then he will have to head home and come back only after completing 2 years.
Do u mean they will pay him his ticket back home too?En what if its not in his contract, what does it mean?
If he has been fired then he doesn't have to pay anything but just double-check the contract that he signed.
Is the company giving him a No Objection Certificate (NOC), if yes then he can find work again and if not then he has to go back to Sri Lanka.
