WHEN I SUBMIT FORMAL RESIGNATION LETTER IS IT A MUST I SHOULD WORK FOR THIS PERIOD?
I WAS SUSPENDED FROM WORK FOR UNKOWN PERIOD HENCE I WANT TO SUBMIT FORMAL RESIGNATION LETTER FOR A MONTH NOTICE,IS IT A MUST TO WORK DURING THIS PERIOD ,DO I LOOSE MY DUES FOR THE ONE YEAR AND 7 MONTHS I HAVE BEEN WORKING? AM AT HOME DUE TO SUSPENSION HENCE BETTER TO RESIGN AND SIT TO WAIT FOR MY NOTICE PERIOD TO END AND GO HOME PLEASE ADVICE
What do you mean "unknown period"? Meaning you have been suspended until further notice?
From what I know suspensions from work without pay should have a specified number of days, unless you have committed such a grave offense that you need to be suspended and at the same time, being investigated during this period.You can seek the advice of the Labor Department.
Effecivity of resignation is usually 30 days upon date of filing, to ensure proper endorsement and turn-over of tasks to the person who will replace you. During this period you should be reporting for work.
The question is, will they let u work during this period. Labor law ( I think Sec.49) says that u gotta work for the prescribed notice period and if u dont u hav to reimburse em the salary for that period or part thereof that u dint work. Also the notice period varies as per your length of service. Say, for eg, if you hav been working in the company for a year then min.notice period is two weeks. If its less than 6 months and durin probation its 3 days , i guess(not very sure...its either 3 days or 1 week)
