transferring of visa

I just want to inquire or at least get an opinion with the current situation of my friend.

She is now working in Doha as office staff, few days after her arrival her employer give her a qadama visa telling that it will be transferred to company visa (same employer) after 180days or at least 6months. After 9months of working there she made a follow up regarding that matter and now the company is telling her that there's already new rule that the transferring of personal visa to company visa can only be made after 2yrs.

My queries are:

1. Is there any such rule?

2. Is there really a chance of transferring her visa to company visa with the same employer or the company just giving her false hope?

3. What is the difference between the qadama visa compare to other visas? with regards to the privileges and benefits?

4. What if the company will not really transfer her visa to company visa? Can she file a complain? Where and how?

5. If ever she will file a complain is there any chance for her to win the case? How can my friend protect her rights?

Though the company is giving the agreed salary (including the free transpo and housing allowance? She is still bother because she never signed any contract from them as of now.

Your response will be highly appreciated

If ever she will resign and will come back here in Doha after 2 yrs. can she get another visa (from new employer)? how about her old qadama visa, it will no longer be existed on her file?Or if ever she will ask her employer to cancel her visa and give her NOC and then she will comeback again here in Doha with the same company & employer, does the same company can get her new working visa?

all their comments above are all true, sad to say.

1. A rule of changing sponsorship in 2 years, YES, you need to use that visa one to 2 years before u can be transfrered. But changing that qadama visa to other kind of visa, NOT TRUE. Changing to another sponsorship is also possible but THE SAME, Qadama visa

2. Converting Qadama visa to company visa like secretary visa is Impossible. But if you have good mandoop, he can do it. But a must to show proof of your school credentials. This is a .05% chance and u need money, effort, patience and perseverance.

3. Kadama visa is for maids or workers to work inside the house and they should stay inside the house. Some holder of Kadama visas were captured and taken to police stations, if sponsor not in Qatar that time, in 24 hours, they will deport. (thats what i heard). Because authority think that you run away from your employer. Kadama visa is not allowed to work as sales or office staff, if caught.

4. It is very hard to complain without any written mutual agreement between employer and emplyment. It's her bad luck, she applied in that company :(

5. You can complain to police maybe, but in the labor, im not sure because you can not provide any proof that they will hire you as office staff. Maybe you can ask help from your embassy.

My suggestion, If you are receiving your salary, try to save and after you resign..apply other country..after 2 years, come back again in Qatar. Anyway, even authorities will ask u why you are working in office with Qadama visa, you can just tell them, "it's your employers issuance and you applied for office staff not a worker inside the house".

a qadama visa means she is not allowed to work outside of the house even with the same employer...if she caught by the police she could go to jailbut its quite rare for police to inspect establlishments these daysbut there maybe hope for her bcoz she still didn't have a contract. if she had, a qadama visa would have been already stamped on her passport. then, there is no way she could get a company visa
