Son to visit can he enter without no objection certificate
My son is 18 years old. He has an Australian passport. (can get visa on arrival). He was living with me here until February. We did not cancel his visa but he has been gone more than 6 months.
Will this present a problem when he arrives at the airport in December? I am asking in the light of the 2 year ban imposed of those leaving after completing a work contract. He of course was on a family visa.
The potential issues that I see are:
1) he is now 18 so not a child
2) his visa was not properly cancelled he just went home and it is expired due to passing the 6 month period away.
3) would an overzealous immigration worker try to impose the 2 year rule and demand a no objection certificate?
Any comments?
As far as I know, NOC is not required for people under family's sponsorhip. It's only for people who are under company's sponsorship.
Just propose a new visa for your son from imigration office here. As long as the new visa issued, he will have no problem to enter.
As far as I am aware, the ban is for those leaving and having a working visa cancelled, I am fairly sure that as he was on a family visa he will have no issue getting in, best to go to immigration and check for yourself to be sure.
