RESIGNATION
Good day. I was employed in my company last January 30, 2012. I was hired from Philippines. When i completed my 6 months work i decided to file my resignation for the reason that the function of my job is not my line of experience and education. Due to consideration i verbally agreed to my company request to wait for my replacement prior to leave my company, but until now since i fled my resignation last july 2012 there is no possible employee as my replacement. This January 30, 2013 is the date of validity of my residence I.D. and i told my company that i will not renew my Residence I.D for the reason that i must go now and i could not continue to work in your company.
My questions are:
1. Is it legal on my part not to renew my residence i.d. because i want to resign after 1 year work.?
2. Could they insist me to work even i do not want to continue to work in the company.?
3. What are the payment i will pay to the company for my resignation.
4. If they will come to the point that they will hold or harass or pending my exit what are the important move i will make to fight for my right.
Please help me, i felt stress with this matter.

kabayan, try to seek for advice from LABOUR DEPARTMENT - Al Muntazah. we almost have the same problem. i went there and they gave me advice. it is up to you if you want to file a complain in LABOUR DEPARTMENT - Industrial. but i suggest you go to Muntazah first to find out about your rights. They are friendly there, and i can say they are so much pro-employee.. don't be afraid, because it is what i also felt before. ok lang dun, punta ka.. mababait naman sila.
What type of contract do you have, unlimited period or for a specific time frame? Refer to Art. 49 of the Qatar Labor Law. Technically, nobody can stop you from resigning as long as you satisfy the minimum requirement for giving notice to your employer. Get ready for some expenses that the employer might charge you such as initial visa processing fees, medical fee, air ticket from origin to Doha and other miscellaneous fees that they can think of just to make your life more miserable. The possibility of not processing your exit permit might also be an issue. You know how “evil” the minds of some employers here are. Anyway, worse comes to worst, maybe you can consult the Phil. embassy or POLO for advice first then the Ministry of Labor or NHRC for greater problems in the future. Best of luck on your resignation. yaah,your resignation is your right but if they need to put you in trouble, they will blame you and they could creat problems against you. if somebody has better idia i hope they will suggest you. best of luck.
