Check with the bank if the cheque is still valid. If it is, then you can present the cheque for cashing. Since there will be no money in his bank account, the cheque will bounce. You can then ask the bank for a letter which would state the cheque had bounced. Tell that person of what happened to his cheque and that you have a letter from the bank about it. If he still does not pay you back, you can report the matter to the police based on the letter from the bank. They police may block that person's bank account and even his exit from the country if he is a foreigner till the matter gets sorted out.
