Beliefs in the heart are in the outward actions of an individual. Hence, a person who does not pray five times a day is termed a disbeliever. And his wife is ordered to divorce him as a result.
Every apostacy case must be evaluated individually in order for a scholar to establish whether punishment of death applies or not.
And yes I don't like it either nor do I think all scholars/people of knowledge have the capability to judge such matters. But I cannot prove it is not in Islam.
