IS THERE ANY EXEMPTION CLAUSE FOR THE PROPOSED ADVANCE CHEQUES REGULATIONS, PROPOSED TO COME DURING MAY 2010.

I have been in the same situation in the past and have successfully got out of it. so here are a few questions...

what does your agreement state? does it have a clause that you cannot terminate the agreement before the end of the contract date unless you have to leave the country for good? If this clause is there you are legally bound to the contract and cannot do anything but stay there (and pay rent).

but if there is a clause that you can terminate the contract mid way by giving an advance notice, then the law is on your side...so here is what you must do.

you need to go the the police station of the area you belong (not Capital Police station) and file a complaint. the police will at first be reluctant to file a case and will tell you to go the Capital Police...tell them u already went there and they have clearly stated that the latter is responsible for registation of the complaint. carry all evidence that the contract supports your cause and you have given the notice. Be persistant and do not leave till the complaint is registered. It is advisable that a lady goes as they are more sympathetic when this is the case.

Once the case is registered, a file will be opened and they will call/follow up with the landlord and make him return the cheques (as now their primary responsibility will be to close the file).

then go to the bank with the copy of the police complaint and apply for stop payment of the cheques. Some banks need an endorsement from the capital police station...if this is the case, it will be complicated...so simply withdraw all money from your account. even if the cheque bounces, the landlord will have to pay you the cheque bounce charges.

the landlord will be compelled to return your cheques and if he has previously deposited the cheques which he shouldnt have done, he will have to return the money/cheque bounce charges.
