Hello,

Could anyone help to clarify what sponsorship law is about? I only have a vague idea that it restricts you from changing job once you are working for a company in Qatar. Is it correct and complete?

BTW, for those who have finished your contract in Qatar, do you return to your homeland, or find another 'nice' land in Middle East, Asia, etc. for further adventure?

All companies,qatari or non qatari,must have qatari sponsor...so either way is same,without NOC u cant leave company...

hi i would like to ask as i need a help

i was working in qatar for 8 months then i resigned and left qatar, my contrat was for 2 years and i did only 8 months, now i am 1 year and 8 months out of qatar, i want to go back coz i got job, i wanna know if i need 2 years out of doha or less, coz i have heard if u are 20 months of qatar , u can come back, so please helpppppppppp

can anyone advised about NOC. i arrived here last December, then i got a working visa, now i found a new employer but my sponsor don't want tog give me a temporary 6 months permit instead they will give a released. is this possible without completing a year?

sorry I am a bit confused about this. Say you are recruited by your home country to work in qatar, but when there, you find a better job. You can't quit the first (home) company to join the other (qatar) company? Unless after serving for  2 years and subject to the first company issuing a NOC?

 

Or lets bring it a little further. Let's say you complete the 2 year stinct with the first company (ie recruited from home country), then instead of returning home, you decide to continue to find employment there, you still need the home company to issue NOC?

 

Or is this NOC thing only applicable to local (qatar) companies and employees recruited locally? ie recruited after arriving at qatar

Aren't they on about changing the law so that you will be able to change sponsor at the end of your contract or possibly getting rid of the law altogether??

they never answer phone calls you have to go and pay them a visit which is in front of Muntaza Petrol Station.

Second you can report them too with ur contract which doesnt state that incase of resignation you have to pay them back any amount,

and when you win spit on their face FOR ME.

I would like to contact the Qatar Labour Office to Clarified something.

But I couldn't find any contact number from the web.

Anyone there can help me? this is urgent cause my company want to deduct the fees for Work Visa Application which cost about QR3000 upon my leaving from this company. I'm working in this Company for about 8 months. and i tendered my resignation end of Dec. Please help me if you know the number.. Many thanks!!!

Hamlet would you please explain a bit more about the kind of person or company one should look after ? My business visa is ready and I will have to leave my daughter and my wife and come to Doha for living and working !!?

I am all confused about this sponsership law of Qatar . I think it is very rude !! Now you have mentioned that don't work for companies run by local arabs and even egyptians and just work for government and big companies and or westerns ?

Now the question that realy bothers me alot is that , does this sponsorship law and 2 years contract and having to obtain NOC from employers refer to Local Arabs , or the law is the same for local employers and foreign employers both ? If the same then why would the locals bother the workers so much ? Because in that case workers would not go to them in the first place ?

And if the law differs , then what is the law for the non arab companies ?

I would greatly appreciate your help on this . It means alot to me .

Hi guys,

there seams to be a lot of confusion in regards to the sponsorship issue !?

First to get the Sponsorship System explained:

A sponser (Qatarie Citizen) takes responsibility for his "proteges".

If one decides to get a bank loan and sail in to the sunset, he will have to clean up

after the sailor... In order to prevent these, he the one will have to approve for

most of the things that have caught headache in the past.

-Gas

-Water

-Electricity

-Cars

-Bank Accounts

-Loans

-Credit Cards

-Alcohol

-Travels

-etc.

In order to keep the control, one is not free to come and go. The coming is depending largely

on your country of origin. There are 33 privileged countries and the all the other ones have more

difficulties of getting in. But once here "we" are more or less treated the same way in term of

the system, not the practice !

A sponsor is free to issue or grant a so called multiple exit visa, under which you are free to come and

go as you want ( for a fee of approx. 400QR/year). I am not sure if there is a rule on who is accepted

in term of job level. Engineering and Management titles facilitate many things, even when just on the paper.

Depending on what country your from (the 33 or not) you can come on a visitors visa, project visa or residence/work visa. Where visitor visas have their time limits.

Once you have your sponsorship and work visa you are more or less at mercy of the sponsor.

I never heard of any limitation on when one can transfer from a sponsor.

In case one wants or needs to transfer, then the individual needs to get a NOC, none objection letter in

laymen terms. That simply states that the sponsor does not object of the transfer.

IF NOT issued such a NOC, then the individual is blocked from applying for another work visa for 2 years

after cancelation of the visa. The same applies if ones visa expires and is not properly renewed or canceled.

Certain employers/sponsors with a lot of power can even apply a blacklisting of the individual,

meaning the blacklisted person can not even return as a tourist (provided the person is from the 33 countries).

Under certain circumstances, like when a employee has not been paid his salary for 3-4 month,

the labour commission can issue a "forced" change of sponsorship if the employer can not provide

prove of payment (but again it depends on where ya from, other ways they are usually faster in deporting one).

Thats the mechanisms behind it in a nut shell...

Depending on who the sponsor is, every step is blurred... and can take forever.

But if all goes ok, a change can be done in one day. 3 pieces of paper, a signature, company stamp and

halas !

There is thousands of people changing sponsors and jobs, but you only hear about the sad and bad ones.

At the end of the day, it depends very much on the PRO (public relations officer) or fixer as we call them,

who handles the papers and fees (and in-official fees) on how things go.

BTW, I am currently going through the same routine and I don't know the out-come yet !

Guys,

First thing is One cannot change a job for 12 months. This is my information , I am not aware about 24 month restriction.

I have seen two scenarios to mention, both happened in my office within last two months.

two sales engineers left our organosation and both had completed 28 months.

One engineer left because he got a better offer in UAE. This guy was given NOC and exit visa easily maybe because he is from Middle East.

The situation with the other engineer is entirely different. This guy was terminated (for what ever the reason). As I understand after termination Exit visa / NOC and all the dues are to be cleared ASAP. But this guy is still running between pillar tom post but no dues cleard to him / No NOC & no Exit visa. This gentle man is from subcontinent.

Everythingh here is upon the whimsical ideas of the sponsor. One fime day we might not be even walk without his signature.

In Bahrain its normal for employer to arrange a multiple exit and re-entry visa . Is this possible in Qatar

So how does the sponsorship law work with respect to spouses? I am here working for a western employer and my husband is coming shortly and intends to look for work. If he works for a local firm and doesn't like it and would like to change - how does that work? Also we have multiple exit and re-entry visas through my employer. If he works for someone else will that effect his ability to come and go as he pleases under my employers visa policy?

i read my 17 page contract for a hundred times already and it is silent about all these immigration/labor laws. it only says either of the party may terminate the Contract without giving any reason for the termination, in accordance with labor law #14. in this case the party intending to terminate the contract shall notify the other party in writing not less than one month.

Does still mean the labor/immigration laws prevail over my contract?

If the service contract is of limited duration, the duration thereof shall not be more than 5 yrs. This period may be renewed for a similar period or periods by agreement of the two parties.

If the contract has not been renewed and the parties thereto continue to abide by it after expiry of its duration without an explicit agreement, the contract shall be considered to have been renewed for unlimited durations on the same conditions provided for therein.

The renewed duration shall be considered to be an extention of the previous duration and the period of service of the worker shall be calculated as starting from the date of his entering the service of the employer for the first time.

You CAN change sponsor after 1 yr(not 2 yrs)- of service with the same employer/sponsor as per Immigration Laws even if you dont finished your 2 yrs. contract.

Provided that, your sponsor will give you NOC/Release. BUT, even if you worked with your sponsor for 10yrs or more, if he refused to give you release to another sponsor and cancelled your visa from the Immigration., you will be banned for 2 yrs. to enter Qatar.

On the other hand, even if your sponsor will give you release within 1-yr. of working under his sponsorship. You CANNOT change your sponsorship to another one.

That's Immigration Law!;)

3- selling a car

4- going on a vacation

5- getting ur wife and/or ur family

6- subscribing for a phone landline

7- taking any bank loans

all these u should get his approval b4 doing it .. the only thing was left for us is going into the toilette without his approval ...

Sadly same here .. i'm stucked in my company .. after i came here i know about this law and the worst thing is i accepted a job which is not in my field . just as a way to put my leg inside the country and after that i will try to find better job with better salary .. but i found my self stucked and even i got an offer 4 times my recent salary .. and they told me forget about the release .. no one in this company is taking a release UNLESS he was contracted internaly .. but if it's externally then there is no way ..

At least i'm waiting for the 2 years to pass (1 already passed) who knows may be the new law will come to light .. after the 2nd year pass if i couldn't get the release i'll be going back to country ..

Think Twice as they all told u .. Think twice .. if the offer is not good enough don't waste ur time .. At Least 10,000 Q.R as basic salary .. PLUS house allowance and transportation allowance ..

in my contract the working hours and holidays are ok....the only loop hole in my contract is that it doesn't get renewed automatically, and it finished more than a year ago...but I don't know what is the statues now...do you think i can claim the salary of all the past year, even though i didn't work with them throught it!!!! i would love to do it for revenege!!!!

Novitta that is my case now :(((( I got my dream job after years of hard work and studying and doing all the right things, I even got the famous book "what color is your parachute" and followed it, and when I landed on my perfect job, the old sponosor is still not letting me go :(((((

i have tough time dealing with them, finally when i went to Qatar Labor Office and found out that they violated a clause in the contract they bargain not to pay the penalty instead they give me a release...

in this case you are lucky. But sometimes the employer will not give you NOC and let you move on to another company with better job out of spite.

yes novitta...the employees are totally helpless infront of the mighty spnosor....I left work a year ago, and I had very good relation with the company I used to work in and excellent record, and now I have a huge new offer with more than double my old salary...and they are still not giving me the NOC or transfer permit...I feel very angry and helpless, and there is really nothing I can do...my advice to everyone is don't come to this country if you are going to work with local, or arabs-run company...only work for the goverment, big firms, or westernes run organisations.....

You cannot change employer for the first two years which is normally the minimum contract period. You can change employer only (after you finished your two year contract) if your previous employer issues you a NOC or no objection certificate. Otherwise, you have to exit the country and have your new employer issue you an entry visa. That is my understanding of the sponsorship law as explained to me by some of my friends. I may be correct or wrong.

it basicly states that you are a slave to your sponsor (or his deputy as in my case)...it sucks man, and if you are not coming to a real good job in a respectable place (mostly this translates into a place run by non Arabs, specially Egyptians)don't waste your life by coming here...Hong Kong is much better

You can't change your job, buy a car, go out of the country, open a bank account, ....etc without his consent.....
