Holiday entitlement pay

Dear Friends

I have worked for one of the reputed company for more than 2&1/2 years. Due to the requirements and the work load I use to go for short holidays such as week or 10days. I use to get paid for my holidays, at the end on mutual agreement I resigned the company on good terms.

Further I have my leave entitlement (due days were 69days) the company has objected paying my entire 69days ON MY SALARY PACKAGE they said that they will pay my leave pay “computing on basic salary” meaning the housing will not be paid. I really don’t see any logic or legal point why I should not get paid my full leave salary.

For example:
Basic 16,000/=
Housing allowance 8,000/=
Transportation allowance 1,000/=
Total package QAR 25,000/=

Paid 30days leave salary “QAR 25,000.00

As I resigned and moving to other company. The existing company decides and argued that they will pay my leave pay computing on basic salary. PLEASE ADVICE IF THIS IS CORRECT. OR SHOULD I GET PAID FULL QAR 57,500.00 FOR 69 DAYS OR BASED ON BASIC SALARY CALCULATION QAR 36,800.00

calculation will only be based on your basic salary...

it should be base on your basic salary, not entire package, even ESB calculation is the same as well.

Can I please butt in with my own question....I started work at a school in February this year. The offer letter stated holiday pay depending on attendance. I have thus been informed that since i am here 5 months july and August salary will be 50%

Is this okay? Is there any way I can contest this?

Article 54

(...) the end of service gratuity shall be (...) not less than a three-week wage for every year of employment. The worker shall be entitled to gratuity for the fractions of the year in proportion to the duration of employment.

(...)

The last basic wage shall be the base for the calculation of the gratuity.(...)

calculation:

69x16.000/30 = 36.800 QR

computations of leave entitlements should only be based on basic salary and should not include the allowances.

eg.. basic salary 13,000 (multiply) by 12 (divided) by 365 days = your daily rate (multiply) by number of days of entitlement = your leave entitlement.

u get ur end of service gratuity according to ur last basic salary.
