Is Transfer of sponsorship possible if having worked with old sponsor for 2 1/2 years?
Originally hired from the Philippines with two years contract and was extended for another year. Extension of contract will expire in August. If a better offer comes along, what are the chances that the old sponsor will release? If in case the old sponsor, which is a foreign contracting company, will not allow transfer of sponsorship, can the employee seek the assistance of the Ministry of Labor?
The decision whether to release you or not still rests on your employer's hands. Even you worked for more than the required 2-year basis, still the final decision is from them. Labor Department cannot interfere in this issue since your company has all the right to give or not to give a release considering that they brought you here from Philippines.
The only thing you could do is to persuade your employer to give you a release if better opportunity comes. And that's what happened to me.
Completing TWO years is a criteria from the Immigration to change sponsorship.
But from the Sponsor, a NOC is a must, He shoud kindly consider to release you. No other way. Hence pls keep him in good humour to get release
U have to get an NOC from ur previous employer.. whether ur contract is finished or not, it doesnt matter..
