I need please an advice for an issue that i am facing lately...
I am renting a house through a company.. the contract is in my name... i rent the 2nd room to a girl.. she was staying with me for about 4 months.. every month she was paying me i was signing a paper from her .. Also i asked a deposit which she gave it to me and i sign for it...
Lately she was misbehaving on the house.. till the moment that a friend came to the house and she was smoking.. my flatmate got mad and she threatened her and me with a big knife that she grabbed from the kitchen.. i really got scared and i report the incident to the real estate company and they told me better to go to police to make a report...
i went to police i made a report... and i told her to leave the house immediately.. she left the house... police when sked me what i want to do to her.. i told them i want her to leave the house nothing else..
yesterday police called her and she went there.. and she wants the deposit money BACK!!! and she keeps threteaning me... i cant believe.. she attacked with a knife and she dares to say that she will make a report also about the deposit....
my question is do i have the right to keep the deposit?? she forced me to kick out her, and now i am without tenant and i have to pay by myself the whole rent... and she attacked me also...
can you please if you know anyone or you can you advice me...
Police told that the report went to public procecution...

OK, let's unpack this detail by detail. She didn't "attack" you with a knife, she threatened you while holding one (legal difference.) You decided to cancel her contract, you owe her money. Two separate issues.

but i took permission from the landlord when i was going to rent the room.. and they told me if there is a permission from landlord is completely legal... this is not the issue the issue is the attackkk
you will be in big trouble for subletting your apt.
To Sublet portion of your home is illegal. You would be very, very wise to return her security deposit ASAP as I do not believe she has caused any permanent damages to your property (house)

if u really want a peaceful life that no one else will bother you, just simply give her deposit. unless there is a contract that if any violation of rules of your tenant their deposit will be forfeited.
Better you retrun the money .
