My friend worked 20 months from contract period(2 Years) in electro-mechanical company as a Engineer. He has 18 months once air ticket also. he is already applied the vacation.
Suddenly his superior send to letter(Bad performance) to GM.
So, GM decide to terminate that person.
In this situation what action we will do?
In my opinion working as a staff for admin/HR for years, a superior cannot just accuse an employee of a "bad performance". There should be sufficient grounds justifying this evaluation. And, if such employee really is showing poor performance at work, such employee should have a prior warning by official notice and definitely not abrupt termination. Check your friend's contract again and proceed to the Labor Department for further advice.
Before going to the labour department try to negotiate with the employer and solve the problem and request for NOC, so he can come back in Qatar immediately any other job without any ban, otherwise if he is leaving from Qatar without NOC he will get 2 years automatic ban.
A peaceful settlement not possible then let him Approch the labour department. Even the employer need to terminate his contract they should give him 30 days notice period. If he go to the labour department atleast he can get his end of service benefits and the ticket. Giving visa transfer (release to other employer) is completely employer's descreation as per the labour rule. He can fight for his rights.
