Dear QL,

I need your comments.

One of mine friend was locally hired from one company to other in last year. Now new company does not have any more work and it seems they are going to send my friend on long leave OR cancel.

So can he demand for Release / NOC. and in case company does no give NOC then he can complain at labour depaertment. Or whats can be any other option.

Plz comments and thanks also.

I always thought that NOC is the sole discretion of the employer.

However, just recently i heard from someone who has been here for decades that in the case of local hire, there is law which gurantees that NOC will be given. Unfortunately, i cannot confirm this by providing and reference to the written law. Just what i heard.

Better if u seek advise from Labour Dept about this. Maybe there is law about this situation and secure a copy of that law if there is any.

most of the time, when locally hired, employers gave release/NOC. BUT, NOC is a company or sponsor's discretion. You cannot force them to issue and you have no point even if you bring it to the labour department.

Better to speak, ask and request one to your employer/sponsor. They will give you an answer!
