NOC Rule

Do you think that NOC law is justifiable? Shouldnt this be written in the contract or at least the employer should inform the candidate before signing the contract, about this law and discretion of the employer of giving or not giving NOC? So that Candidate has the knowledge of this and he/she can decide whether to join or not?

All five fingers are not same. Some employers are good and are considerate. Others take this law and try to blackmail the employee. For example... we will give you the NOC if you do this and that even after termination/resignation for two months... and so on... it really is a mental torture for the employee. .. May Allah save us from oppression.

And that's the point really. Well put corcaoich, especially for those who come to Qatar for the first time. If they have never worked somewhere where an NoC is required before then they wouldn't necessarily know to ask the question. Equally even if they did have the wherewithall to read it on the internet they may not really understand what it means.

Who knew these restrictive laws existed before they came to Qatar? In the internet age, maybe they know, if one has access to the net. When I came I had no idea and so would a lot of other people. One would have expected that if one finished one's contract, or if the employer did not need your services for whatever reason, one could seek alternative employment. That is why people are shocked when they find that this NOC system exists.

Nope ! Expats should follow the rules of host countries. NOC is not a problem for them.

There should be a clause in the contract as well.

This issue should be ask directly to the HR during the interview so from there he/she will know if the company is willing to give NOC after the duration of your contract. So from the start an individual can decide whether to join or not.

So company have no obligation to put it in the contract..

No, why should it be in the contract? It in the law of the country, you can look it up if you want.

Do you expect employers to write every law of the country relating to employment? Look up the Qatar labour law online and you can read all the clauses.
