need help terminated from job for no reason

Hello Dear Friends

I have got a friend of mine working here in qatar from past 18 years , he was locally hired by his company , butnow he is fired without any particular reason, as per his contact he is suppose to get end of service . but what concerns him is he is staying here with his family and his child is continuing education here in qatar, he used to be decorated employ with lots of benefits from the company but now he dont want to go back to his country but instead wants to start some buisness here in qatar , but when he asked for release his company is not willing to give any release, is there any possibility for him to get release and also end of service, also compensation for his loss during the period of running a case if he files a case in labour department

A locally recruited employee has no special rights or privileges under Law. NOC, it is at the sole discretion of the employer...

Refusal of NOC is a perfect example of how employers regard their workers. Even after many years of good service.  I wish for once they would practice what they are supposed to do according to th good book.

Mr. Lobot if you dont know the law dont argue, it is not right of local hired employers to cancel his visa unless the company first provide the visa, if he goes to court, court will support the employee only. You are still in the mind of slavery era. The real case, majority are afraid to file a case against their empolyer/sponsor. What leagal right to cancel someone's visa after locally hired from Qatar?

well he should get NOC if they just layoff himbut if he was terminated for some serious reason then he can not get NOC18 years is a long time, so company should give him

Well ps.qatar1. I suppose you have been here for quite some time to know what dirty games go on out here on a regular basis. The top guy (actual boss) might know nothing of what is going on down the line and the middle level manager is the one playing the dirty tricks. I have seen colleagues played around with and removed in the name of recession, lack of business, new ideas,etc by this middle managers and then new persons have been recruited who are from the managers state or country and who help the manager in his own agendas, enrichment process and in sticking to his chair.

Your friend has a right to claim his benefits. About the NOC and release letter even the heavens cannot help him if his boss is not willing to give it to him

Your friend is entitled for the end of service benefit and approaching the labor court will solve this matter in a snap. Because this is a clear cut denial of justified entitlement. However a release is something that is not governed by law and is at the sole discretion of the sponsor even if he was hired locally.

no he is fired for no particular reason , the reason what his boss say is he is in the service for a very long time now also his company admin and Hr is ready to give him release but his direct boss is the one who object to do it , what his HR say is if your boss say OK the company dosent mind givng Release

well, if he has been fired by his company, I suppose the company should provide him with a release letter and then he should get a new Qatari sponsor to start his business

either locally hired or wherever planet you hired it's still the employers prerogative to give you NOC...

did the company fired him and proceeded to cancel his work visa immediately?? If that is the case then there is not much to be done but to leave the country.

On the release/NOC and eventually and acceptance of sponsorship transfer is a sole decision of the employer so it does not matter wether the person worked 1 yr or 30 yrs...if the sponsor says no release/NOC will be granted that's it.

Sorry but on the other items you ask I have no knowledge whatosever.

If he is locally hired he have the right to ask for release they cant refuse as per law, and if he is hired directly from his country it is up to the sponsor. but he is entitled for End of service as per Qatar labour law, if they don't want to pay ESB labour dept is with him dont worry. Just file a case immediately.
