HELP: Position canceled after accepting Job offer and resignation from current employer.
Dear QL members,
I had been offered a job at a new company, signed the job offer and the new company uploaded the change employer form on ADLSA to which I received messages that it has been accepted by ADLSA.
As per the procedure, I have completed 1 and a quarter months of notice period already with my current employer. Now less than three weeks the new employer has canceled the position and informed that will not be moving forward with the hiring.
What are my rights according to the law? Now I am destined to job-lessness assuming I cannot return back to my current employer. Is there a law that can support my case and what damages can I claim from the new employer? A formal contract with the New employer has not been established but a job offer was signed by both parties as a new contract could only be done after the notice period.
If you would have any "rights" your new employer would not have dared not have dared to cancel the position. But then, he knows very well you can do nothing. That's why many unscrupulous employers play their "games" without the slightest fear of retribution.
You may try your luck by lodging a case against the employer at the Sharia court. But you will need to be running to the court for several months before you get a verdict. During this period you will remain unemployed with almost zero income. Your new employer knows this very well. Whether the verdict will go in your favour is another matter you need to keep in mind.
Just return home wiping your tears. You will need to keep several handkerchiefs ready in hand.
Alas, there are so many loopholes
