My understanding is that, this means that where the hours have been set, i.e. the employee will work for 40 hours per week, the rest periods have been calculated into that 40 hour working week.  So, a one hour break may be paid for as part of the 40 hour working week.  I have yet to see a minimum H&S break requirement... your employer may elect to give you only 20minutes paid for you to eat lunch... this is unclear.

To be honest I don't think this is in the labour law...we work 12 hours and have an hour unpaid......same the world over as far as I'm aware....
