Reagarding Final Settelment

Dear Sir,
I'm Working in Qatar Since 2005 till Date (October 2012),
Between this 7 yrs ,I went for an emergency leave on December 2007 due to family issue and unable to return back immediatly,it take for me almost 10 months ( From December 13,2007 to September 26,2008 ) to come back for the same company in same visa paying some penalty (paid by company) and resumed my duty.
My Question : Now i'm planning to resign from my service in this case how my final settlement will calculated
1. From August 2005 to October 2012
Or
2. From September 2008 to October 2012 ( after my 10 months break )
or
3. From August 2005 to October 2012 (Excluding the those 10 months break from my total period of service )

In my opinion option 3 is fair and also the legal one.
