Gratuity Calculation - 6 yrs after january 2005

Even after checking the queries on QL, I have still some confusion over Qatar laws on gratuity.

As per Qatar Latest Law for Gratuity, How many days should I entitle to get gratuity if I work from 1 January 2005 and last day of working is 31 dec 2006 (Will it be calculated 21 days X 6 years
28 days X 6 years.

Somewhere I read that if completing 5+ years, gratuity will be calculated as 28 days (latest basic salary) per years.

Would really appreciate if someone could clear my doubt

Thanks

end of services benefits is 3 weeks worth of salary, per year,

it is only payable if you work for more than one year

easy way to calculate

take monthly salary x 12 (months)

divide answer by 52 (weeks per year)

multiply answer by 3

the answer if your annual ESB, if u worked 18 months,

you multiply your weekly salary by 4.5 weeks.

hope this helps

by the way it was your latest basic salary only.

My understanding (I work in the QP downstream) is that the calculation is NOT based on days but on Months - in other words one months basic pay (current pay that is) for every complete year of service and a pro rata'd amount for parts of the year if you resign before the next anniversary of joining the company.

As per the labour law in force 21 days X no. of years. The old formula of slabwise calculation is no more valid.

My knowhow is as follows:-

21 days per year for the first 5 years

28 days per year for the next 5 years or part thereof.
