lucky luciano...do not give misguided comments
terminated or resigned...both are entitled for it
Yes. He is not entitled for Gratuity
Does this mean if some one is laid off (termination due to downsize) and have only 9 months of service, is not entitle to the Gratuity? please guide.
Dear yiqbal84,
Employer shall pay the end of service gratuity to the worker who has completed employment of one year or more. This gratuity shall be agreed upon by the two parties, provided that it is not less than a three-week wage for every year of employment. The worker shall be entitled to gratuity for the fractions of the year in proportion to the duration of employment.
Gratuity = ( basic salary / 30 days ) multiplied by 21 days per yr .
Thanks & Regards,
