End of contract benefits
Good day to all QL members.
I am working for a Oil & Gas construction firm here in Ras Laffan Industrial City. My yearly contract with the company will end soon and I am planning not to renew my contract with them. What am I entitled to monetarily? The 21-day annual leave + 21 day end of service benefits?
Article 54 partly states… “Such end-of-service benefits have to be agreed upon by the two parties and should not be lower than three weeks salary for every one year worked and shall be paid according to the period of work.”
What if there is no agreement stipulated in the contract between the company & me? I am confused.
Yes, you are entitled for your holiday pay pro-rata.... If you have completed say 9 months of a year and are entitled to 21 days holiday per year, they will need to pay you on a pro-rata basis. I.e It won't be the full 21 days of holiday pay.

Definitely yes to 21 days for ESB. I don't know about holiday entitlement, but torc seems certain you should get that as well.

mr. torc, based on your reply I should be getting 42 days (ESB+leave entitlement) when I leave the company, right?
mr. mohdkhan, my co-employees who have gone ahead of me (they did not renew after one year) were only given 21 days ESB. That's why im a little bit worried. Their case is not any different from mine. If someone like you will handle our accounts dept, I will be at peace.

Yes, you are entitled to 3 weeks pay per year. If you are leaving after a one year contract and have not gone on holiday, you will also be entitled to your leave settlement as well.
Why are you so bothered now, becuase you have already planned to leave the Hen which is laying the golden eggs. Their is no point in getting confused now let the Accounts Department calculate the dues and settle the account anyhow don't be bothered they will not cheat you.
Regardless of what your contract says, you are entitled to 3 weeks salary for every year you complete.
