Anybody Please Enlighten Me.. Leave Encashment & Gratuity Before 1 Year??

I'd joined a company in Nov'2008 on company provided business visa, which was later converted to work visa in Qatar itself in Jan'2009. I got my RP pasted on passport in Feb'2009. Now, my queries are:

1- Legally I would be considered Employees from Nov'2008 or from the date of RP on passport?

2- In our company the Employees can take 1 month additional salary upon completion of 12 months if they do not go on Vacation.
If I resign from the job or company terminates me before completing 12 months, say in 10 or 11 months, will I still be eligible for partial annual leave encashment, in proportion for these spent 10 or 11 months?

3- If I resign or company terminates me before 12 months from the date of joining, will I still be eligible for gratuity?

I work with the company from 1997 todate, i resign and going this july. how much should i get End of service pay if;

a. 1997 contract is silent about end of service pay (it does not say anything about it).

b. in 2004 i need to process visa for my child, in that day i need a contract so the company did provide me a contract with date back of joining to 1997, which says that gratuity "WILL BE PAID". these document was signed and stamped by labor dept. in 2004.

c. again in 2006, same thing is required for another child, but these time gratuity "AS PER QATAR LABOR LAW"

the company says end of service pay only start on 2005/1/1, thus i got only from 2005. is these correct.

your input/comments is or will be highly appreciated.

It depends on the contract,

And contracts here was not the only item of this period very close, in general, you can ask one Modvin you have in the section they Cevedonk more

Hi,

You must stay and work for 1 year and it also depends on what contract you signed in the begining.

If you signed some kind of temporary contract and then later signed a permanent contract the date will begin from your permanent contract. It has nothing to do with when your RP was issued it depends on what contract you signed!

1 year service? But from which date? The original date he arrived or the date he got the RP? I'm in a similar situation and I'd like to know what to expect next year.

1 Year continuous service is required so you can be entitled for any benefits from your employer.

Dude! as per the countries labor law....

1) you gotta finish up atleast a year to get ur things u kno i'm sayin 12 months, if u dont u won't get anything except ur salary, the days u worked...got me?

better u would stay atleast for a year...if u really wanna get ur things back...good luck man!
