Dubai: A Filipino whose wife died in an accident involving a car he was driving has been ordered to pay Dh100,000 as 'blood money' to his wife's family and his children.

Joseph Aboutan also has to pay Dh20,000 for damaging a lamppost he hit with his car.

The Traffic Court of First Instance found Aboutan guilty of causing the death of his wife.

He is presently in custody at Al Aweer central jail in Dubai.

Aboutan recalls the day when his wife, who was on a visit here, was sitting next to him when his car hit a lamppost and overturned. He was arrested and taken to jail and his wife Imelda, 34, was admitted to hospital with serious injuries.

Aboutan never saw his wife after the accident as he was in jail and she was in the intensive care unit at Rashid Hospital. She died in hospital 25 days after the accident.

"Since the day of the incident two months ago I have been suffering day and night," he told Gulf News from his cell. "I do not have the money to pay the blood money or the fine," the 35-year-old Filipino said.

"We are poor people and I came here one year ago to work and help raise my three kids," he said.

"I have no clue what to do. I loved my wife more than my life. She was an adorable woman. I want to go home to my children and my family. I need help," he said

Aboutan, who has been working for a private company in Dubai, is the father of three young children, two boys aged 13 and 12 and one 10-year-old girl, who are now staying with his mother-in-law in the Philippines.

He said the incident happened on a Friday morning at 7am near Century Mall. "I got out of the car to help my wife. The last words she said to me was that she could not move her body," he said. "I never saw my wife after that."

He said he called the hospital from jail. Nurses at the intensive care unit held the phone to his wife's ear so she could listen to him, but she was not able to talk.

Aboutan was detained at Al Muraqqabat police station for 25 days, while his wife was in intensive care. He said all his pleas to see her were ignored. Two days after the death of his wife, Aboutan was granted bail by the traffic public prosecutor. He was arrested again early this week and was instructed to pay a fine for damaging government property as well as blood money.

"It is impossible for me to pay such an amount. I am desperate and I miss my children a lot. I called my children to tell them I am sorry for the loss of their mother," he said.

cant believe that they didnt let him see his wife in the hosp for almost a month..

Accidents happen,whether its his fault or not,..his wife died..thats punishment enough..hope he makes it to his kids soon..

insensitive cops and birdbrained use of the law..esp if u compare with the way the other case was dealt with(where the kid died in the car bcos of the parents..

feel sad for this guy and his family. This guy should have got a chance to see his wife at least before she died. Pathetic to hear that she was in hospital for 25 days before dying and this guy was not even allowed to meet her once. All those cops should have been in jail for human rights violation!

How does anyone know whether this was an accident or not. The cause of the collision was not mentioned or discussed at all. As example suppose he was reading the newspaper when he hit the light pole?? Still an accident?? Many countries are moving away from the term accident when related to automobiles in favor of the term "crash" or "collision" because it has been proven that the vast majority of these incidents are someone's fault - therefore someone is responsibible either through an action or lack of action (negligence). None of us here know the facts of the case yet we are ready to judge....

if someone dies in a road accident, the person responsible has to pay blood money, that's the law...

So this man has to pay for his wife's death...

But in the case of the two year old who died after being locked out in the car, it wasn't a traffic accident, it was negligence... it may have happened in the car... but that is incidental, so its up to the judge to decide...

This is like the pregnant lady who's baby died due to reckless driving... she was asked to pay blood money...

its pretty simple...

One year jail for motorist in death crash

A local man was found responsible for a crash in which seven people were killed, including five members of a family, in April 2008.

A Doha court sentenced the 27-year old motorist, who escaped unhurt in the accident, to one-year imprisonment but it suspended the penalty.

The accident occurred close to the Abu Samra border post as the family was on their way to visit a farm. It was a

Friday afternoon.

A traffic officer told the court that the defendant was “speeding at 160kmph in the fast-track lane in a street, where the maximum speed was 120kmph”.

The court also learnt that the deceased driver of the other car - which was carrying the bereaved family - was driving in the middle lane and swerved leftwards towards the suspect’s car and the former couldn’t avoid the collision, due to his extravagant speed.

Explaining the conviction, judge Mamon Hamour said: “The suspect drove his car in an extravagant speed, which made the collision, with the car coming from his right, unavoidable.”

Judge Hamour explained the suspension of the jail penalty saying that the court “took into consideration that the driver of the other car, who died on the scene, ‘equally shared’ the responsibility for the accident.”

The crash claimed the lives of two sisters (aged 12 and 15) and three of their cousins aged three, six and 10 beside the family’s housemaid.

The case file showed that the car carried the seven victims had a comprehensive insurance and that the suspect’s car had third-party insurance.

The court ordered the convict to pay, jointly with the two insurance companies, a blood money of QR150,000 to the families of the six victims.

The court ruled that the family of deceased driver - the seventh victim - is entitled to receive QR75,000 – “half of the blood money) for his responsibility for the accident.”

Three more siblings, aged then around 14, were seriously injured in the accident. The court said they are entitled to receive injury compensations of QR57,000, QR166,500 and QR48,000, based on a medical report showing their status.

The injured children were said to be making “progress” after receiving treatment in the UK.

The verdict is still open for an appeal in a higher court.

my question is about Punishment !

In both cases accident happened and in both cases they suffered the loss of their beloved due to their negligence.

But why one got behind bars and other walked away freely?

Honestly, this is purely discrimination of Nationality!!

At least Govt should have put the parents behind bars for few months or whatsoever... or else they should have asked the husband to pay the penalty for the damage for the light pole and walk away because he suffered a lot same way as the parents suffered a lot for their child.

About blood money, I agree that if his wife family demands he has to pay as per the Law whereas in case of child there is no blood money since the parents are his beneficiaries.

To make is more simple. There should be unified law that Anyone who intentionally or unintentionally take the life of any human being should go behind the bars.

Rest other issues such as blood money or damage money will depends on the nature of the case.

SPEED.. Because parents do suffer for the loss of their children unless they were insane in which case they need professional help.

If the parents were Muslims, they are considered sinners unless they fast for two months.

And if they have to pay blood money, they will pay it to themselves!
