Hi,
I was terminated from a fixed term contract.
In the contract was a clause that stated employment may be terminated by either party giving one months notice.
Is this an "Onerous" or " unfair", contract term, and does it still stand in a fixed term contract?
There was also a clause, which stated,
"Employee shall not be engaged or concerned in any other business other than with the employer, without his written permission". Is this clause void?
Theo his been on a rolled on contract ...
Here is what it says in the NHRC Workers Handbook.
It is illegal for any
of the contracting parties to separately decide to end the
contract after the probation period indicated in the contract
has ended end to do so would render the termination
of contract illegal granting the wronged party to sue for
damages.
Booklet
As per the Qatari labor law only permanent contact can be terminated by the employer any time during the tenure of the contract. Get legal advise your case may be straight forward if you sue your company.
If it can be terminated at anytime, why does it stipulate a fixed term?
This would then make it an open ended contract.
Why you asking this ? its been written in all labor contracts with all clause pertaining too its not only this clause there are more in correlations. If you are given one month notice before being terminated fine , if not you have no choice, the second clause you mentioned is not void , if your employer catch you will be terminated immediately ...
