Steven Smith, Ohio Man Who Sexually Assaulted 6-Month-Old Baby Girl To Death, Seeks Mercy

Steven Smith, a condemned Ohio killer, is making an unusual plea for mercy ahead of his scheduled execution next month. His argument for mercy isn't an easy one.

Smith acknowledges he intended to sexually assault his girlfriend's 6-month-old daughter but says he never intended to kill the baby.

His lawyers say that the girl, Autumn Carter, of Mansfield, died because Smith was too drunk to realize his sexual assault was killing the child. Ohio law is clear, they say: a death sentence requires an intent to kill the victim.

"The evidence suggests that Autumn's death was a horrible accident," his attorneys, Joseph Wilhelm and Tyson Fleming, said in a written argument prepared for the board.

The Richland County prosecutor says Smith continues to hide behind alcohol as an excuse, and calls Smith's actions "the purposeful murder of a helpless baby girl."

Prosecutor James Mayer told the board in his own written statement that the girl's injuries are consistent with a homicide that contradicts Smith's claim he didn't intend to kill the girl.

If executed, Smith would become the 51st inmate put to death in Ohio since the state resumed executions in 1999. The state has enough of its lethal injection drug, pentobarbital, to execute Smith and two other inmates before the supply expires. Eight more inmates are scheduled to die from November through mid-2015.

Besides even if he didn't intend on killing her, he still committed a crime that warrants capital punishment in many parts of the world!

However I do acknowledge I am not a learned judge.. just an emotional mother, and thankfully not tried with the agony the baby's mom is in today! So really neither can I say with certainty that my judgement of what the criminal deserves is correct, nor can I say what I would have done if in the unfortunate mother's position!

You hear cases all the time of neglected children who don't attend school, grow up in violent households/neighborhoods, etc. These are the kids who turn into criminals because they know no other way of life. In the West, every citizen CAN get a decent education which enables him/her to take care of themselves.

First off, things like TV, Playstation, & education are not guaranteed in prison, they are given as rewards for good behavior. As is being allowed to exercise, being allowed out of your cell, being allowed to socialize, etc. All of this is taken away swiftly if you cross the lines.

Jailers need methods to control the prison population, or prisoners riot, harm others, go insane, etc. You cannot keep them locked up in their cells 100% of the time, they do need to eat and wash.

Also, these people who are living on the streets who commit crimes to go into prison in the winter, what crimes are they committing? Murder? No. Usually petty theft, vandalism, etc. These people are not monsters, they are totally able to be rehabilitated. Countries like Norway, Sweden, etc with strong rehabilitation programs have the lowest rates of re-offending criminals. I can't remember where I read it, but Con's the earn a GED in prison are over 50% less likely to re-offend when on the outside, Cons that earn a University are over 80% less likely to re-offend.

People generally commit crime due to poverty, lack of education, and drug use, these are all fixable things, and perhaps if the US spent less money on executing one guy and more on work & education programs in prison, they would see their prison populations go down.

There have been many instances of criminals fleeing jails... in many countries...sometimes due to fire and sometimes of natural disasters... there should not be any iota of chance... for a criminal to repeat his crime... especially of pedos & rapist...

It is better for them than to live on the street in winter.

Prisons often offer opportunities to get an education, to have 3 meals a day, medical and psycholigical assistance , Plus, there are no responsibilities, all is taken care of...which is handy for those who can't or do not want to handle their lives themselves.

LLR my friend if we are going to think practically tell me, If a person knew he would get the death penalty "for sure" if he killed another person do you really think that person will not kill? If i'm in a fit of rage at that moment i kill someone i'm not bothered about what happens to me afterwards, but then i might repent, should i not be then spared the death penalty and given a life in prison to regret my killing?

Or lets say a serial killer for example, you think he will stop killing at ONE person just coz of the death penalty..you kill one or you kill thousands..punishment will be the same. So there again is no such "guarantee" that having the death penalty will stop people from killing.

No one is angle here. I have been friend with some jobless people..after trying for few months I heard these sentences from them "Ohh i wish i go to prison cuz I will at least get free food and place to sleep" So just imagine if ur sure you will be locked up for life then people will purposely kill each other.

If everyone of us is stable in terms of money mind morals you can apply these laws of just locking them up for life...but we r not same..some of us are ready to die just to satisfy their ego..

Think practically...In fact after all these strict laws you cant stop crimes (100%)then what you are expecting by easing these laws?

They have the death penalty yes, however its there for those that commit "intentional" murder, first degree murder, even if the person commits first degree murder but is clinically proven insane he cant be given the death penalty. Look at the number of death sentences they have had over the past just 50.

Oh I missed that point. Asking for mercy is ok. He is also a Human Being but should not be pardoned. The easiest way to kill him is to cut his head as scientifically you will have a very little pain if you die like that. Though it looks horrible to see blood shed but the person who is dying will have no pain as soon his veins disconnected from each other.

To kill someone to protect other innocent human beings or your own self in defence will not make you a killer. In my opinion you will be a hero.

First of all he is not asking to be pardoned of his crime, he is asking for mercy to be shown towards him getting the death penalty..this in no way means he will be let off scott free. There will be a punishment eventually.

Secondly I'm not saying this is adultery i was giving you an example. The crime for adultery in many rural villages of India/Pakistan/Afghanistan for example is death FYI.

it was not adultery.. he was drunk..he sexually assaulted 6 months baby girl and she died... This is not adultery. I have friends who get drunk like dead but never tried to harm anyone. It is your real heart which makes you do things u think before you get drunk.

Death by accidents have different approach. The person who was involved will have shame and will try to compensate to the victims family as much as he can. If it was an accident most of us can assure that he wont repeat the same again but in this case u cant assure it.

Personally If I get drunk and commit that sin I myself will ask government to kill me or hang me cuz the pain of shame would never let me live...here this guy want to be pardon because he has no shame...if he has no shame he will do the same again.

He made a huge loss..he did not kill the baby girl he killed her whole next generation which was suppose to come from her.

If you take the death penalty out from your laws, now or later, one day no one will feel safe in this planet.

I want laws something like Newtons Law action/equal reaction.

He deserves to be tortured first and then die a slow and painful death.

That being said..the "Law" states the death penalty to those that "intend" to kill. In his plea he says he didnt "intend" to kill. But a death has occurred due to his other intent to sexually assault the baby. In such a case the death penalty cannot be given coz thats like saying I intended to get drunk and dive a car but didnt mean to meet with an accident and kill the other person.

He should be judged for the sexual assault of the minor.
