Judges side with US against Sudan factory owners

WASHINGTON — A federal appeals court has rejected a lawsuit by the owners of a Sudanese factory destroyed by the U.S. government following terrorist attacks on American embassies in Kenya and Tanzania.

The U.S. retaliated for al-Qaida’s 1998 embassy bombings by conducting a missile strike against the factory the U.S. government believed had ties to Osama bin-Laden’s terrorist network.

In a 9-0 decision Tuesday, the full appeals court said the judiciary has no authority to review a claim that calls into question an executive branch decision on national security.

The owners of the Sudanese plant say the attack ordered by then-President Bill Clinton was unjustified.

Sanctions against Libya couldn't be justified especially over assumptions. It seems to me the UN,ICJ,Security council are there to serve the desires of the fittest.

Maybe one day, the US will apologise to Libya,Sudan,Japan,North Korea,Vitenam,Iran,Iraq...etc , maybe who knows...

Well technically Libya OFFERED the money to the families of the victims of the Lockerbie bombing so that they would have sanctions against them released. Those sanctions were put on because the person who committed the bombing was a member of the Libyan Intelligence Services and it looked an awful lot like Libya and ordered him to do the bombing.

Lockerbie is a one off situation that was never done before or since.

I think when you seek millions of $ as a compensation for the victims of Lockerbie and you compensate an Afghani or an Iraqi with 1/100th fraction of that amount, then yes, you are racist.

Do you know how many years it took for Germany to apologize, and I doubt Libya would have if not forced to. And you can hardly compare the Holocaust and the Lockerbie bombing with the provoked bombing of a factory that killed 1 person.

Germany is still paying compensation for the Jews and did apologize several times. Countries and governments do apologize. Libya had to compensate every single relative of Lockerbie case. Countries do apologize and compensate.

Apology for what? They have not admitted to anything. They dropped the case to avoid matters of national security from being made public, not because they were wrong.

Show me an example of one country accepting the mistake for such an incident and apologizing for it?

I think that independent investigation was valid, it was carried by a Boston unviersity professor as a supervisor, otherwise the US gov would challenge that investigation.

If I remember correctly the bombing did get media attention 12 years ago when it actually happened, as did the bombings of the two embassies which killed dozens of people. Ever hear the saying All's fair in love and war.

This apology should be directed to the sudanese nation, at least one guy died because of that bombing, my point is that some events get huge publicity, attention and sometimes compensation. I guess the west is very selective.

Also I'd call into question the validity of the "independent" investigation. After all it is being paid for by the guy (or the guys lawyers) who's trying to clear his name, so while it might be independent it's hardly unbiased.

How does this matter differ from the many actions of self defense that many countries have taken and never apologized or accepted? The matter that his funds were released itself is a big deal and wouldn't have been possible in most parts of the world.

I still don't see how this is a double standard? What is this being compared against? How is this racist? What race is being discriminated against here?

Not a single Penny was received and It was proved by an independent investigation that was a pharmaceutical plant manufacturing medicine, but I guess some people are not objective. The US will never admit any mistakes whether killing a Chinese pilot or occupying Iraq.

Apology for? Have they been proved they were wrong? The case should be lodged in some international organization like the U.N against the U.S, and not in a Judicial Court which cannot try a case against the National Security division.

It doesn't say there was or wasn't one, the article simply said that the federal court had no authority to care through the suit. For all we know there was some compensation and an apology, or perhaps the Sudanese factory was connected to Al Qaida. There's not enough in the story to really say.

There was an independent investigation after the bombing which clearly indicated that factory was responsible for 50% of Sudan's needed medicine ,but I guess Sudanese lives don't qualify for a compensation unlike Lockerbie...
