Whether an expatriate worker would need exit permit or not to travel overseas would be decided by the job contract he signs with his employer once the sponsorship system is changed.

The worker can also put a condition in the contract, subject to approval of his employer, that he would be changing the job at the end of his contractual period.

This was disclosed by the Minister of Labour and Social Affairs, H E Dr Abdullah bin Saleh Mubarak Al Khulaifi, at an International Labour Conference in Geneva yesterday.  

The Minister said procedures to remove the sponsorship system (regulated by Law Number 4 of 2009) were on at a quick pace.

After the sponsorship system is gone, a contractual system would be put in place. The contract inked between a foreign worker and his employer would regulate the relationship between the two, said Al Khulaifi.

“The contract will decide whether a worker needs exit permit or not to leave the country. And whether he gets no-objection certificate to take up another job at the end of the contract would also be decided by this contract.”

The wage protection system (WPS) for workers is being finalised. “It is in the last stages.”

Exchange houses are also being made part of the WPS network along with banks, said the Minister.  It will be mandatory for companies to transfer their workers’ salaries to banks or exchange houses every month.

If a worker wants and provides his bank account details in home country, his salary could be credited into this account directly, said Al Khulaifi.

Relevant provisions of the labor law are being amended to facilitate the launch of the WPS, according to him. “Work on the WPS is proceeding very fast.”

Now all the Employers will make the contracts as "Undefined" so that the employee should stay for five years with them without increment, bonus ETC. Nothing has changed and nothing will be changed. they are saying indirectly to go out from Qatar by making these rules.

Islam clearly says treat people equal!!...it does not say treat Qataris equally and treat expats differently.....first there should be respect for people in this country or the Qataris should bring in a system where the people are treated like humans...at present its like, they decide when a employee can travel, where to travel....pure human rights violation.....and i believe they will never realize that.....once we should take these Qataris to our country and show them what hospitality is.......i have personally many times gone through scenarios where you feel insulted by "big shots" in big CAR...and i believe they wouldn't do that if we were also in a big CAR....

any how am sure there is no change gona happen...this country lacks vision.....GOD BLESS THEM

some of the sponsor tried to contact labor dept. but he threw them in jail for 3 or more months just for asking help from labor dept....now what to do....showing the innocent a way but sponsor steal their innocense....

Not getting paid is a different story. I am sure labor department can help him if he reports this. Exit permits is a must to protect the employer to assure that employees are cleared from financial obligations before leaving as many just come to this lovely country to hustle and steal from. Then once this person is gone, guess who can find him to bring him to justice. No one!!!!!!

it is very easy to for you to say this. and infact i wish that my dad would leave but his sponsor does not issue exit permit without any reason. he did a lot to the sponsor company. and in return, he gets nothing, not even his salary which he didnt receive from last 3 months.

All I read above is complaints. If you do not like the law, Just leave back to your county or go work in another country. No one has forced anyone to stay and work here.

All of these drafted laws yet to be implemented, seems to be the worst. I am very frustrated of human rights here. Infact, instead of human rights, they have Qatari rights. My dad receives threats by his employers every single minute, every single day. My dad sincerely doing his job but his sponsor is very dangerous. I am really worried for him. He cannot get release because whenever he demand release letter, he threats him. Infact he did the same with one of his employee already.

So, I must say that these are QATARI RIGHTS not HUMAN RIGHTS or LABOUR LAW.

it is just a joking all this kind of labour rules u will never heard if they changed just saying when we change .. all companies they know no one can do them anything . can you imagine before i arrived to doha i sing 10 papers wich they are saying agreement and when i reached doha i sing another agreemant and now my company told me their is no contaract .. Good, it means you are fully with them. Now it is your right to understand and keep the contract letter, the original, not copy. Make sure you have it as soon as possible because as of now, your company is violating "Article 15" of the labour law... When you have a copy of it, also make sure it contains every clause mentioned in "Article 38" as well.

Mr. Thilzath, how do know you have change sponsor when you don't have a contract letter?. Your present employer may be keeping your NOC but that doesn't mean they are keeping you. Ask for your contract letter and if you don't have it within a week or two then ask for that your NOC and leave them because they are just hiding behind your first sponsor.

Its mean already I was work another sponsor ,he made two years contract agreement .after one and half years I got better offer from another company.so my sponsor release me.

Then I was joined with present company since 1 years completed. they are not made any contact for me but changed sponsor.

in the end, the govt could retain the same old situation, difference being you will be told in the beginning itself that you wont get NOC if you wish to move and you have to get exit permit through the company. whats the difference? just the name. it happened the same way as many of us had predicted that nothing is gonna change. take it or leave is what they always give us.

All these sounds funny to me. Visas are issued by Sponsors/Employers. Validated contracts can only be signed when the employee enters the country. The worker would have "no right to put any conditions" because your visa itself came from the same person you are trying to make conditions with. What if the employer rejects your conditions, you are still his property because your visa is his'. What will be your last option? GO BACK. Many people choose to stay because they are trying to compromise the troubles left back at home. Has anyone thought of the chances if your employer rejects all your conditions?...

Before workers were coming even without contract so still what ever contract will be there worker comes because he/she need work but i think no one employer mention on contract that our employ will get NOC in future and no one company will allow any employee to go without exit permit so its same as current rule and what about 2 year ban?

The company can require the employee to sign a contract with the condition of no NOC and Exit Permit Required in order for them to retain his current employment. The same can be applied to new applicants desperate to come over here in search of greener pasture. With the above conditions being a possibility, what is changed? Nothing. Employee is still at the mercy of the employer, aka sponsor. Same ol', same ol'.

well...i am having a problem in leaving the country as i have to attend to some urgent personal work. i am unable to travel sue to some license issue in the company. It is so unfair to hold a person back from being able to go home. Its the labor law system that's holding us back. we have the right to go home to fulfill our responsibilities towards the family.
