Dear Friends,

I need your advice regarding the issue we are encountering. My sister in law arrived here in Doha Sept 9, 2010 with visit visa for 1 month. She found a job as a customer service assistant and was hired 11 October 2010, her visa was transferred to a working visa already. During her stay she was involved on an issue that lead her to decide to file a resignation. We were told that the company will not provide her NOC and as far as our understanding he needs to exit the country. She's just 20 years old and we want her to stay for a couple of months maybe until 2nd week of January 2011. Please help us understand what needs to be done or is there any option for her to stay for a while. Any response will be highly appreciated. Thanks

even if the company give her a NOC, by immigration law she can't transfair sponsership for one year or is it six months. any way that what i think the case is.

Thank you so much for all the advice and clarification on the issue. I admit everything did happen so fast without considering what will happen in the future. but as you said what is done is done.

If so, then you did concede/agree...which is equivalent to an NOC.

Anyways..it's over and done with. As family, just ask them for the 90 days grace period. They will agree...just have faith.

I remember signing a letter but i think that is for the transfer of visa from visit to their sponsorship. No other letter was provided to them from us.

I have an NOC from my previous sponsor but then again, it won't do you no good.

The NOC should be in the company's letter head paper :)

I don't know about your sis-in-laws company...but she's too young to work. I wouldn't even hire her even if she's qualified....no offense meant.

If she came here under family visit visa, you must've have given them a No Objection for her to work and transfer her sponsorship to them....did you not?

If sponsorship is transferred the company drcided on NOC. If she resigns they don't have to cancel RP immediately, can wait til January or whenever! Many people in that situayion here.

If something is unfair in the work environment, she can approach Labor Dept. and Human Rights committee for an exemption. If this is because of a better work offer, no chance at all!

Now, the best thing you could do is talk with the HR management. When you go there, bring a written letter of request and have it received by them.

Just explain to them to give your sis in law the 90 days grace period (as mandated by the Qatar Labour law) before they cancel her visa.

Like I said..talk to them...you got nothing to lose if you go there and speak with them.

Yes Azilana...she has no any bad record with the company since she only worked for almost a month, she's still under probation and still a trainee. My wife is thinking abourt all day for the past few days now and hopefully we will have a resolution on this issue.

Usually, if with NOC...upon effective date of resignation, the person who resigned has 90 days to look for a new sponsor.

I think it's the same thing for people without NOC.

Communication is still the best option. Go to the HR Department and speak with the manager. Send an e-mail to the Management.

I'm sure, if your sister-in-law is leaving with a good record, there won't be any problem...

I hope that will be an option for us since there no one in our home who can assist her if she will go home alone.

If she has a really good reason for resigning, you can ask the sponsor not to cancel the RP till January.

If that's her destiny maybe we need to deal with it. But hopefully she will be provided an NOC. Im thinking to seek help from a Qatari friend and seek help from her.

Nut if NOC will not be given, can we request her visa to be extended (not cancelled) until we go on vacation on January 2011?

Thanks tinkerbell10...regarding the reason, its basically something that may affect her psychological and emotional strenght that we decide as a family to leave her job. She's only 20 years old and we dont want her to be invlolv.ed in a situation that may change her life forever. That's why i tried creating an account here hoping to find answers and option for us so she can be with us till we go home for vacation on january. If i need to shell out a certain amount to do it i will probably bite that option, if there's any.

If the RP is not stamped what visa she will hold while on stay or until she find a new job?

that RP is stamped or not, if not stamped, then no need of NOC or anything she can stay here andn can join other company also, if RP is stamped on her passport then NOC is required.

Not yet, she havent receive her pataka yet but she's done with the finger printing last week. No idea also if the RP is already stamped on her passport. She is not formally resigned because tomorrow is the schedule to submit the formal resignation letter.

NOC is sole discretion of the sponsorer, they may give or not no body can question them as law is with them, now only option left out is to ask NOC from sponsorer politely stating some genuine reasons and request them for the same.

Thanks for the reply i really appreciate it. So is it possible that the company can give NOC for her? is there any reason why they will not give NOC? or can i tell them i am willing to pay just to give NOC to her for her to stay longer with us? sorry if have a lot of inquiries. we really wanted her to stay for a while, because we'll be having a vacation in januray and we want her to stay until we go home.

yes you can change the law of the state of qatar so your sister can stay.

as already she is in residency permit, nothing can be done, and if sponsorer is not giving NOC she has to make an exit, now legally there is no option, only option is to request the sponsorer politly for NOC.
