the've been a conspiracy to terminate me by my boss

Hi,pls can anyone help advise me on what to do? Here is my story,I have been working here in doha with a company for 10 months now and my boss and i have not been in gd terms because of discrimination,favouritism and in short poor management of associates.Lastly i met him at his office to share ideas on how we could better manage out associates to make them happy and not think of resigning as many are already thinking to do.I pointed out clearly to him that our staff are resigning because of mismanagement.that got him furious and i was clear to him that i will inform the company high authourities about all these happenings.for these reasons since he as always been looking for ways to terminate me,he conspired with some female associate to report me to the HR that i once shared a sex talk on duty with them about 4-5 months ago.truly it was a topic on sex education in which we both shared and joked about then.my boss without giving me any notice or calling me to enqire capitalized on that,made the story big and presented to the HR that i should be terminated.i went to the HR and was terminated even when i had never received a warning letter before.My question now is that how can i do to get a release or an NOC from the company since am a local hire?i approached them for the NOC and they said they don't give NOC's but that they will have to send me home.in this case what can I do? pls advise I just want to add now that i just read article 57 of qatar labor law and it states clearly as follows; that ,Upon termination of the service of the worker the employer shall at his cost return him to the place from where he has recruited him at the commencement of the engagement or to any place agreed upon between the parties. so with this law i think its but normal that as a local hire they have to send me back to the streets of doha from where they picked me before.but the big question here is do they even follow this laws?pls help with an advice.or should i present my case at the labor office???

thank u brothers for ur concerns regarding my situation.I work too for a hotel under katara hospitality and 2 days ago i went to explain my situation to the katara hospitality management stating clearly to them that am a local hire and had spend about qr28000 to come to qatar from cameroon on a free 5yrs work visa before being transferred under the hotel and that now that i've been terminated i plead for the NOC so that i can manage to get another job.they replied that they will contact the hotel management and will get back to me in two.untill now i've not received any call from katara but the hotel HR keep threatening me that they can hand me to the CID.the reality of the situation now is that before the termination i send my passport to my country cameroon for renewal since we don't have an embassy here and when i called the cameroon embassy in KSA they told me that through the embassy it will take minimum 5months for the passport to be renewed n sent back to me here but advised i i should sent it home directly to the immigration for renewal where it will take a lesser time to reach me back.so with this situation i can't travel and the HR is behind me as if i committed a crime that if i don't get the passport as soon as possible then they will hand me over to the CID.this morning they called me to give to them the tel number of the embassy in KSA so that they can get me a travelling certificate to permit me move.well it a hard situation but i think with this pressure tomorrow i will go to katara hospitality again to plead with them and even present to them an offer letter to see what they will do.Thanks again men for the concern.i will keep updating u guys till the last day.bye to u all.

Bilal, thank you for sharing and feel sorry for your situation. i have a friend who was working in the hotel under Qatara Hospitality - and was told that it's not issuing NOC.... but his boss backed him up and NOC was issued. try to find someone who can help you... good luck!

ok much more clear now and that's very helpful from the lawyers i must say...well dude, if the owning company has an official 'no NOC' policy in place, then yes you are facing a dead-end; many companies such as Al Mana and most banks have official no NOC policies and my advice to all people is always to get this most critical matter discussed WHEN you take the job; not when you want to leave it. I asked this question at each of my two job interviews and even got it written in my contract for the first job; the second employer told me verbally that as long as I wasn't dishonest, I could trust them to issue the NOC..and now that I've been terminated last week due to personality clashes with my boss, they have kept the trust and told me to look for another job within 6 months...so please, anyone reading this, do not leave such a critical matter to chance and treat it as MOST important aspect, over salary/perks or ANYTHING ELSE that is imprtant to you in a job...

Bilal, bro I'll be honest, it's not looking good for your case and even though God can do what he wills, I suggest you mentally prepare to leave...and next time discuss the NOC if you find yourself faced with a similar culture as Qatar...best of luck and I'm sorry for your situation.

hey brothers,i send a mail to a law office for advise and they responded thus;Thank you for your email.

Our lawyers advise the following:

We do not handle immigration matters, but to the best of our knowledge NOC is not a legal entitlement, irrespective of whether a previous employer granted it and/or the employee was hired locally. NOC is a matter within an employer’s discretion.

Your employer is not legally obliged to give you a NOC, unless your employment contract expressly stipulates that they have agreed to do so.

The Labour Department will therefore probably not be able to help you. Your only recourse might be going to the National Human Rights Committee, but any chance of forcing your employer to grant NOC would be slim at best if there is no legal basis for your request.

The employer must also pay repatriation cost for terminated employees. In practice this means the one way (coach class) air ticket back to the international airport mentioned in your contract or if none is mentioned then to the international airport closest to the place from where you were hired.

We cannot advise you any further. Best of luck in resolving your difficulties.

so in these case I was told by our HR that the decision not to give associates a NOC was not coming from the hotel management or the GM but from the owning company which is Qatara Hospitality so i don't know if i should go and plead with the owning company or not.what do u guys think?

thank u all again.i went to the labor office this morning but it was closed so i called the toll free line n explained to them that i've been terminated by my company and being a local hire they're not ready to give me a NOC.the lady that responded explained to me that if i was recruited here in doha then they have to give me the NOC but that if from home then they have to send me home then she added that the immigration can transfer me which to my knowledge is not possible.I was then advised by a qatari friend to go n complain to the human rights,do u guys think that they can help out???

bro that's likely to be a problem in that case; if you have sensitive info and are working on sensitive projects, then how willing do you think they will be to give you an noc to take this info to some other place? anyways, its a tough scene and all we can do is pray it works out for you...if it doesn't, well then its basically God making something else work out for you and which is better for you...wish u luck

thanks to u all i will move to the labor office tomorrow cos my company is trying to push me out and what ever be the outcome then i will update u guys

the truth about the whole story is my company knows that i have very useful and delicate information's that if the government get to know then the contract where i work will be at stake cos i work at one of most sensitive places here belonging to the state

so their idea is if am pushed out then all will die down.but for me i just need the noc so that i can keep working here n not moving home as planned
