Tenancy Agreement

I recently signed up a tenancy contract for moving into an apartment in 3-weeks time. However due to a personal issue I am not able to move at all and advised the agency 'within a day' of signing the contract that I will not be able to take up the apartment anymore. The agency took commission (2-weeks on rental) upfront and is advising now that they will not refund despite the fact that they have sufficient time to lease the property. Is there anything I can do or have any legal ground to reclaim the agency fee? Appreciate any help, guidance or answers.

FH, The 2 weeks rental commission is to make a deal. Now the deal is closed. So you can not ask that commission amount back. They worked for you, their time & effort have value my pal. ......... ......... If you can find a new tenant for them then it is a different case, then I will sure support you, I will personally come meet the guys to get back our money before the sun sets .............. ...........

Thanks Molten Metal - but I do not understand what loss are you taking about. I signed up and cancelled within a day which is giving them ample time to lease the property to someone else. You think it is fair for me to be charged the entire agency fee penalty in this case?
It is your decision, you must keep your promise, you will spoil their business if you do not keep your promise where ever you go ................. You should bear the loss no the poor agency guys .....................
You can take the matter to the Rental Disputes Settlement Committee which is located near Holiday Villa on C Ring road.Try your luck with them. Taking the assistance of the Court will be very time consuming and it may take up to six months or may be more to get a verdict and you will need to be present on all dates of hearing. The estate agents know of all this.
