Noc requirements

Hi all

My friend is working as an engineer in a private company for one n half year..the company has been irregular in salary since a year. Now he hasnt recieved his salary consecutively for 4 months. He has got an offer for job in another company but the present company is not giving him noc. is it possible to get noc if he tries to move legally by involving the labour court?
