married woman, back to islam getting married to a muslim

Hi Folks,

I got married in Oct 2005, and separated with my husband in May 2006. I got a job here in Qatar on July 07.

I met an egyptian guy in Sept 07 and we have plans to get married soon.

My Fiance told me that I have to get a "no-objection'letter from my ex husband.

Will anyone give me advice on other legalities, pre-requisites to get marry.

That is sharia law which is not recognized in the Philippines. And besides, no one knows if her husband has long since converted. If this lady ever wants to go back home she could be in trouble.

mistah, as per my knowledge, when a women converts to islam, she has a waiting period, an iddah, if her husband converts to islam then she can live with her husband, and if the iddah period finishes then her marraige gets nullified, and she is free to marry whomever she wishes,

OK, let me be real clear. Until you have your husband declared legally dead by the Philippine authorities or you apply for and are granted an annullment or decree of nullity you cannot remarry. It's bigamy and it's illegal. Even if you or anyone else cannot find your husband, even if your husband is bigamously remarried. I'm really sorry for your situation but these two options are your only (legal and moral) recourse.

from what ive read, abandonement is only a ground for legal separation (not nullity of civil marriage) and in which still you cannot marry (assuming you win the case for legal separation). you can marry only if you file a petition that such abandonement consittutes psycholgical incapacity (one of the basis for nullity of marriage).

I dont exactly know if he is still living or died for sometime because of his job nature. I was trying to locate him even his family never knows where he is and what happened to him. Besides i am a muslim and he is not and i know even if he is present he will not convert to Islam because that was the thing that we argued so many times before and muslim woman cannot be with non muslim husband. So this make my head twirl...

If my understanding is correct that there is no legal divorce in the Philippines then you ladies are certainly still legally married until an annulment is granted by the Philippine authorities. Therefore, even if you could find a way to marry here in the Gulf you could still face problems if you ever returned to the Philippines. I certainly hope there are no children involved.

Shavonne, if you have full annulment, i.e. decree absolute then you are free to marry any one, also a Muslim. But if it only a Decree Nisi, then you need to wait till decree absolute after that you are entitled to marry anyone, As far as I am aware there is no requirement for a Muslim women to seek any kind of no objection letter from her ex-spouse for re-marrying.

This also my biggest burden noe because i am separated from my christian husband long time ago without any communications or any knowledge of his whereabouts. I am also a muslim convert and would like to marry a muslim guy but i am so confused what to do. Anyone can help?

Why don't you ask your embassy here? I'm sure they have power-of-attorney procedures for some matters. Maybe they can point you in the right direction.

Ur wedding or civil marriage record is not here or registered here in any court it was registered there back in ur country u need to consult them from there.

are you just seperated from your ex husband or divorced from him?

are you a muslim?

either ways to marry your love, you need to have the divorce or annulment from your previous husband and it must be a notarised document, then in all probability you will also have to get it attested by the ministerial authorities in qatar.

once this is done, insha'allah there wont be problems for you to go ahead and marry.

They court will ask u for letter attested from ur authorities that u and ur ex got no more relations. that u don give a damn about ur Ex and he so too.and hold no resposibilites on behalf each others. eeeeeh simple thing u don wana get to him back right so go get divorce papres signed its that simple.u dont know him and he dont know u any more.

well u being a muslim u have to have a reason that ur ex-husband was not gud to u or u wanted to convert to islam ..in this case u can take divorse ,,but if u love some one else ..n then wana divores ur ex-husband then its not in islam n as well in law

We only have annulment in our country though.

I was told that if I get to be a muslim, then get this letter from my ex-husband, I can marry a muslim.

I was told that if my ex husband will not convert to islam, that's it, I can marry a muslim.

If u are divorced than ur Ex-Husband got no rights to interfere in ur personal life and you may carry on.

But if thats not the case than u do need to get divorced to wed an other. this is a matter of life time.

No Need For No Objection Letters.
