Landlord Crisis

Hey guyz,

I need some advise. Heres the full picture of the story...

I rented a house around 8-9 years back. The initial rent was 1400 then increased to 1600, then increased again to 1800 and then increased to 2000. I was happily paying the rent on time as the rent was a dream rent for a villa of that size.. :) and then I delayed the rent for a few days in last November as my father got sick and I thought that I might need the money as my father was hospitalized. When my Pa was fine and back home after a week in hospital, i went to the landlord's office to pay for the month of November which was delayed along with next months (december) rent to cool him down for any bad feelings for the delayed rent. As expected, he didnt take the rent and told me to vacate the house or face the court. I requested him to increase the rent no problem as i have never been to a court or a police station in my life. No was his answer.

Now the case started. I went to the wrong court as was mention in the papers but the hearing was in Al Sadd. So in short i missed the first hearing. Then the second hearing the land lord didnt show up. On the third hearing the actual land lord didnt come as his brother came. It was explained to the Judge that the land lord wants to increase the rent and we are ready to pay the increaed rent but he is not agreeing to this. The Judge asked me if I had paid anything or any amount in the court during the period of court process. I told him No as I did not pay the rent either in the court nor to the landlord's office. After hearing this the Judge told us to come for the fifth hearing. Anyways when i went there for the fifth hearing i got a hand out froom the court that I should vacate the house and pay the remaining rent. OK... I went on a house hunt but i did not find anything between 5000 which was way over the budget...

Anywyz I paid the remaining balance to the landlord and asked his new rent which was 5500 per month. Agreeing to it, i prepared the checques and advance payment for 2 months. When i went there, he now started asking for 7500. I agree to it even while i was still in the house. One bad day, the court police came, got us out and locked the place down. I went to the court and got permission to enter the house.

Now the land lord started demanding again for 7500 as rent as we are still in the house without an agreement. I paid two months rent 15000 and asked for the receipt. He did not give me any receipt for the paid amount. He said no receipt without an agreement. Instead he gave me a receipt printed by a coumputer without the company name or anythig official. When i went back with one year cheques, he started asking for 5 years cheques of 7500 each, meaning i had to give him 60 cheques...... which i cannot give.

Now... after that, i have not paid him the rent nor did I submitted anything in the court as the court has already given an eviction notice and they have done their job as we have already been evicted once and then we came back after agreeing with the land lord for 5500 rent. So I think the court is now over.

This was the back drop of the situation that I was facing as I wanted you to know the whole thing so you guyz can advise me properly.

Now the current situation is that after paying 7500 and 7500 per month for two months without a receipt and agreement, i owe him again 15000 for another two months. Now i have found a place and I have moved out. Theres no agreement (formal agreement) and he is threatining again that if i dont pay him 15000 riyals, he will again go to the court. I have all the receipts that I have received from him and that one receipt of 15000 which was not formal official document. Now i dont want to pay him without a receipt and he is not willing to give me the receipt. I am afraid, that if he goes to the court again and if he again wins the case, he will demand again for the rent already paid as i dont have the official receipts.

What should I do...??? Should i tell him to go to the court or do i legally owe him 15000... ??? What can he do, and what can I do...??? Please advise me what should i do...!!!

it depends on court. but most likely they will agree for installments.. what is the alternative? to send you to jail??... but you don't refuse paying, you just need little bit more time...

..it is logically… but you better check with some lawyer the legal side of this matter

he is OUT already. As per my understanding all Landlord wants is to get his 2-months rent at once, not by installments.

There seems to be no agreement, in the beginning he should have told the Landlord he would pay the rent a little later due to the family circumstances.

It is not just ok not to pay the rent late without explaining before.

Without a leasing contract he will not have a leg to stand on and to be quite honest if the Landlord had not accepted the rent he should have had the rent paid to the Landlord through the court.

The court would have paid it to the Landlord and things would have settled.

Now he is in no-mans-land with the Landlords desire to get him out and without a contract he can and will raise the rent endlessly to get him out.

I am ready and willing to pay... I also went to his office to pay 10000 and the rest of the 5000 the next month... but he wants all at once and i dont have that amount of money right now. I requested him to take 15000 in 2 installements of 10000 and 5000, but he is not agreeing... He then threatens me to take me to the court. I wanna know if he goes to the court, what will happen...???

.. in this case of course you have to pay him for 2 months that you stayed in this place…Doesn’t matter if you have a written agreement or not…

so you ask us if it’s ok to lie in the court in case if he takes you there? You ask if it’s ok to refer to the agreement where QR2000 is shown, even though later you agreed to pay QR7500? In this case my answer is NO. You cannot do it. You have to pay in full the amount which you agreed about, for the period that you lived in this place. It is just not nice to do otherwise...

Noooo... I think I was not that clear in my earlier posts... Sorry for the confusion. :( I had paid him 15000 for the two months... and after those two months, I stayed again for another two months and then some guy in real eastate business told me that I dont need to pay him anymore amount and get out of the house as i dont have any formal agreement with the landlord. If he will go to the court, the court will tell him to take according to the contract which is of 2000 and is expired.

He HAS left a house already, he paid everything till the last day. But now a Landlord asks him QR 15,000 for the next 2 months, as IF there is a Rent agreement between them.. right, djdesi?

well, as canary said, you have to hire a lawyer, or at least to consult with one of them...

BTW, QR 15,000 is the price for a whole villa?? WHERE??

Why are you asking about this on QL you obviously need a lawyer. One other thing you can do is pay the rent to him idirectly through the court itself, but you really need leagal councelling on this subject.

Your bad luck in this situation is that you don't have a leasing contract and without this no court in the world will be able to help you.

Leave it to all the greedy locals when their properties are stood empty for years and they have no rent money, then maybe they will change their ways ( BUT i doubt that very much, once greedy, always greedy !!)

Definitely you are in a crisis.

I read it and in my opinion, I would left that house and move some where else. Instead to haggle that landlord who is just squeezing every penny out of you.

Stay in the house, and keep paying the rent regularly, if the landlord stomach is full then he won't say anything.
