Gratuity for a terminated contract

Hi all, I would to ask if i can get my end of service gratuity even though i did not finish my contract for 2 years. I worked for 21 months to be exact. I was urged to resign for personal reason.

Can anyone help me on this?

I m confused about this too....after completion of an year with a company, are companies abide to pay the gratuity to the employee irrespective whether its resign/termination??

You are entitled to gratuity as soon as your PROBATION period finished. So if it says in your contract your probation period is 3 or 6 months, as soon as that period is over you are entitled to the gratuity of 3 weeks per year and/or fractions of that time.

Check it like I did - I read it 2 days ago, documentation picked up directly from the Labour Department!

My friend was terminated from his company due to lack of projects and need to revise the office staff,he was given a release and found a new job, until now it would be one year this August the previous company did not give the end of service payment or gratuity, monthly he visits the company to ask for it,but refuses to pay him.Today the Manager told him that he will not receive anything cause he was given a release. Please help

He work in the company for 4 years,last salary was not given,ticket and gratuity..nothung was given to him.

What is the best step for him to collect what is due to him? Thank YOu..please help po Kabayan

a. 1997 contract is silent about end of service pay (it does not say anything about it).

b. in 2004 i need to process visa for my child, in that day i need a contract so the company did provide me a contract with date back of joining to 1997, which says that gratuity "WILL BE PAID". these document was signed and stamped by labor dept. in 2004.

c. again in 2006, same thing is required for another child, but these time gratuity "AS PER QATAR LABOR LAW"

the company says end of service pay only start on 2005/1/1, thus i got only from 2005. is these correct.

your input/comments is or will be highly appreciated.

And if it's not mentioned in the contract, you are entitled to what the Labor Law says.

with cause, you are not entitled. But if it is a mutual consent, then you are entitled to all what's mentioed in your contract!

FS, the Labor Law overrides a company policy. If no gratuity scheme is mentioned in the company contract, the Labor Law steps in automatically.

You are entitled to a gratuity even if you don't work a full year. The Labor law says:" Or a fraction of ...".

In normal case if you have completed one year you are eligible for 3 weeks Basic salary as Gratuity..then again depends on your company policy.
